DOWNLOAD EBOOKThe principle of equal pay for men and women for work of equal value has been key to the European Union ever since its foundation. It was laid down in the original Treaty, and brought into practice by several directives. Also the Court of Justice's case law has boosted its importance. Notwithstanding these efforts at the legal level, the average gender pay gap for the 27 EU Member States (17.6 % in 2008) is hardly diminishing. It is against this worrisome background that the European Commission asked its European Network of Legal Experts in the Field of Gender Equality to collect data on national policies, initiatives and legal instruments aimed at tackling the gender pay gap, and to explore potential links between equal pay and other national legal provisions. 33 legal experts of the EU Member States, the EEA countries and the candidate countries took part in a questionnaire that formed the basis for this publication. It analyses a wide variety of national policies, initiatives and legal instruments that aim to combat the gender pay gap and it uncovers a number of unexpected links between the gender pay gap and other parts of the law.

Part of the variation can be explained by different patterns of social partnership. With current policy pressure to de-centralise collective bargaining and increase the percentage of pay linked to productivity, what role can social partnership play in tackling the GPG? The collection of papers gathered here begins with an in-depth discussion on gender perspectives in constitutional law, which can support gender justice, but also perpetuate patriarchal norms. The book then analyzes the role of the European Ombudsman in the area of gender discrimination. Despite its limited jurisdiction, this institution has become a significant complementary tool in the protection of gender equality and the elimination of gender discrimination at the EU level. Particular attention is paid to the importance of mainstreaming gender into public policies. Thus, the legal and institutional frameworks of Spain and Serbia are presented, which can serve as an inspiration to other countries. Another important aspect covered in the book is an analysis of systemic differences between the average wages of women and men in the six countries of the Western Balkans. In turn, the book presents a discussion on female genital mutilation as a highly gendered crime based on extreme versions of rigid, patriarchal ethnic and religious norms and customs.
