The Judicial department of the government expounds the laws; the Executive department takes care that they shall be faithfully executed; but you, and you alone, are invested with the high prerogative of making and unmaking, at your pleasure, the laws themselves. You have been elected by the people of the State to enact such laws as will, in your judgment, best serve their interests. I assume that you will make no change in our fundamental law concerning representation in the General Assembly, as our increased Senate gives to our large centers of population a representation more in keeping with their great and varied interests; but I desire to call your attention to the injustice in volved in the provision in the amended Constitution, upon which you will act, that provides that a major. Ity of the electors voting cannot call a Constitutional Convention. The work that is before you will principally consist in legislating for existing conditions, that have been brought about by our social and indus trial progress. Morris, Governor of Connecticut, to the General Assembly: January Session, 1893 Now, with the legislative department constituted as we have shown, and with the executive department elect-cd by the legislative department, let us examine the judicial department. The constitution. Provides that judges of our higher courts shall be nominated by the Governor, and ap pointed by the General Assembly, that is, the legislative department. Thus we see that with a Governor elected by the legislative department, members of the judicial depart ment are nominated by him, and are appointed by the same legislative department. Thus, to a great extent, we find that under our defective Constitution the three depart ments of government are merged in one-the legislative department. The framers of the original Constitution did not intend this, but intended that the three departments should be kept separate. This condition of things has arisen through the patchwork of amendments that has been attached to the original Constitution, and through the changes in population and pursuits of the people.
