Delivered in the winter of 1887 and spring of 1888, and edited and published in 1908 by one of Maitland's students, Herbert A.L. Fisher, they cover the period from 1066 to the end of the nineteenth century. Rather than a narrative historical format, they focus on describing the work of the constitution during five distinct moments in English history: 1307, 1509, 1625, 1702 and 1887. They provide an entry to some of the major concepts he later expounded in his seminal work written with Sir Frederick Pollock, The History of English Law. Widely considered the father of modern legal history, FREDERIC WILLIAM MAITLAND 1850-1906] was an English jurist and historian best known for The History of English Law Before the Time of Edward I (1895), written with Sir Frederick Pollock. He was educated at Eton and Cambridge and studied at Lincoln's Inn, London. Maitland was called to the bar in1876 and practiced until 1884, when he became a reader in English law (1884) and professor (1888) at Cambridge. He founded the Selden Society in 1887. Hailed for his original outlook on history, his works had a profound influence on legal scholarship and remain important today.

Excerpt from The Textbook of the Constitution: Magna Charta, the Petition of Right Whatever may be thought of the execution of this work, I have little fear of the chief portion of it being censured, so far as regards the design. An attempt to arrange in a simple form, and to place before the public, in a few easily accessible pages, the great principles of our Constitution, - to prove their antiquity, to illustrate their development, and to point out their enduring value, - will surely, in times like the present, not be discouraged as blameable; and, in the strange dearth of really useful treatises on this all-important topic, it will hardly be slighted as superfluous. I am aware that I assume a more questionable and difficult function in proceeding to consider what political measures should now be taken, in order that our Constitution may extend its benefits more amply, and more securely for the future. But this branch of the subject is intimately connected with the other; for, the same earnest and long-continued studies which teach the historical inquirer to believe in and venerate the great principles of the English Constitution, also display to him the workings of its normal law of progress, its plastic power of self-amelioration and expansion, through which alone we may hope to see the exigencies of the present and of the coming time supplied, not only without danger, but with additional security to the fundamental institutions of ages past. It is in the first place necessary to have a clear idea of what we mean by the word "Constitutional." For, there are few terms in our language more laxly employed than this word and its converse in party political discussion. And so very vague are the ideas which many entertain of the English Constitution, that when the opponent of a particular measure or a particular system of policy cries out that it is unconstitutional, it generally means little more than that the matter so denounced is something which the speaker dislikes. Still, the term is susceptible of full and accurate explanation, though it may not be easy to set it lucidly forth without first investigating the archaeology of our history, rather more deeply than may suit hasty talkers and superficial thinkers, but with no greater expenditure of time and labour than every member of a great and free state ought gladly to bestow, in order that he may rightly comprehend and appreciate the polity and the laws in which, and by which he lives, and moves, and has his civic being. Excerpt from A History of the British Constitution The great nobles of the Norman and early Angevin times would, if they could, have reduced the king to the position of a feudal overlord, cut off from direct authority over the mass of the people by intervening grades of feudal order. That they failed to do so was due to the fact that the anglo-saxon period had taught the English freeman to regard the king as a national officer, and that William the Conqueror and Henry I. Had the sagacity to recognize and encourage this feeling. As a result, an informal alliance between the crown and the people grew up. When the chartered towns began to develop a local political life based not on land but on trade and industry, it was to the crown that they turned for support. But it was not through any wish of their own that the Com mons began to play a part in national affairs, but because the crown called them in to redress the balance of feudal oligarchy. Throughout the Middle Ages political representation was regarded as a burden rather than a privilege. It was Edward i.'s supreme title to greatness that he recognized that the feudal expression of the idea of govern ment by consent must give place to the national. In the writs Of summons to the Model Parliament of 1295, he re asserted the fundamental principle of the Old Teutonic assembly that common danger should be met by means devised in common.
