The fundamental ethical problem in bankruptcy is that insolvents have promised to pay their debts but can not keep their promise. The Ethics of Bankruptcy examines the morality of bankruptcy. The author compares and contrasts the Humean doctrine of promises as useful conventions with the Kantian view of autonomous agency constituting promissory obligations; he explores ethical concerns raised by forgiveness, utilitarianism and distributive justice and the moral aspects of insolvents' contractual, fiduciary, tortious and criminal liability. Finally, the author assesses recent bankruptcy law reforms. Bankruptcies severly hurt creditors and society. For the insolvents and their families the experience is painful and stigmatising, yet philosophers have paid little attention to the moral aspects of this violent social phenomenon. The Ethics of Bankruptcy is the first comprehensive study that employs the tools of ethics to examine the controversies surrounding insolvency, which makes valuable and sometimes controversial reading in a decade recovering from the Recession.

This book will inspire and spark grassroots action to address the inequitable impacts of climate change, by showing how this can be tackled and the many benefits of doing so. With contributions from climate activists and engaged young authors, this volume explores the many ways in which people are proactively working to advance climate justice. The book pays special attention to Canada and the Great Lakes watershed, showing how the effects of climate change span local, regional, and global scales through the impact of extreme weather events such as floods and droughts, with related economic and social effects that cross political jurisdictions. Examining examples of local-level activism that include organizing for climate-resilient and equitable communities, the dynamic leadership of Indigenous peoples (especially women) for water and land protection, and diaspora networking, Local Activism for Global Climate Justice also provides theoretical perspectives on how individual action relates to broader social and political processes. Showcasing a diverse range of inspirational and thought-provoking case studies, this book will be of great interest to students and scholars of climate justice, climate change policy, climate ethics, and global environmental governance, as well as teachers and climate activists.

"Unjustified enrichment" is one of the three main non-contractual obligations dealt with in the DCFR. In recent years unjustified enrichment has been one of the most intellectually animated areas of private law. In an area of law whose territory is still partially uncharted and whose boundaries are contested, this volume of Principles of European Law will be invaluable for academic analysis of the law and its development by the courts. During the drafting process, comparative material from over 25 different EU jurisdictions has been taken into account. The work therefore is not only a presentation of a future model for European rules to come but provides also a fairly detailed indication of the present legal situation in the Member States.
