Numerous countries and regions now have very active space programs, and the number is increasing. These maturing capabilities around the world create a plethora of potential partners for cooperative space endeavors, while at the same time heightening competitiveness in the international space arena. This book summarizes a public workshop held in November 2008 for the purpose of reviewing past and present cooperation, coordination, and competition mechanisms for space and Earth science research and space exploration; identifying significant lessons learned; and discussing how those lessons could best be applied in the future, particularly in the areas of cooperation and collaboration. Presentations and initial discussion focused on past and present experiences in international cooperation and competition to identify "lessons learned." Those lessons learned were then used as the starting point for subsequent discussions on the most effective ways for structuring future cooperation or coordination in space and Earth science research and space exploration. The goal of the workshop was not to develop a specific model for future cooperation or coordination, but rather to explore the advantages and disadvantages of various approaches and stimulate further deliberation on this important topic.

This is more evident today than at any time in the past, due to the intensification of trans-boundary trade, the internationalization of the division of work and the acceleration of technological progress. The Asian Institute of Air and Space Law, the Graduate School of Law, Soochow University, Taipei, the International Institute of Air and Space Law, Leiden University, and the Institute of Air and Space Law, McGill University, have instituted international conferences in order to provide a world platform for eminent specialists and scholars. The Tokyo Conference, upon which this excellent collection of papers is based, was concerned with a wide range of legal and practical questions arising from regulatory developments in international air transportation and in the exploration, exploitation and use of outer space and celestial bodies. The main topics of deliberation were: megacarriers in the 21st century, the need to revise the Bermuda Capacity Formula and the Chicago Convention, liability and responsibility in international aviation, safety, security and environment, airline industry competition, legal and political aspects of space transportation and manned space flights, the protection of the space environment and dispute settlement in air and space law. They are discussed in this volume with unparalleled authority.

The United Nations currently has five effective international space treaties, namely the Outer Space Treaty of 1967, Space Rescue Agreement of 1968, Space Liability Convention of 1972, Space Registration Convention of 1975, and Moon Agreement of 1979. However, with recent competition and movements to mine and exploit natural resources from such entities as the moon, asteroids, etc., these outdated treaties no longer address current advancements. It is imperative that new research is undertaken to urge and progress new space laws and policies that strengthen international cooperation and joint undertakings into the exploitation of natural resources from outer space. Global Issues Surrounding Outer Space Law and Policy grants a general understanding for the current issues and methods of solution in the field of outer space law and policy in the global society. It suggests a revision of the five international space treaties and presents a new International Space Agency (ISA) that would use international cooperation and an International Court of Air and Space Law to promote the speed of work and fairness in trials of air and space law cases. Additionally, solutions for the cooperation of the global community towards joint undertakings and exploitation of natural resources in celestial bodies is explored. The nineties will be a turning point for international air transport and for space activities. Trends in civil aviation and outer space policies show the need to join forces to promote common interests, leading to the strengthening of the 'region' as a basis of co-operation. As international air transport benefits from progressive liberalization at the same time ever greater regional co-operation between governments as well as between airlines is emerging. The European Communities offer a most interesting example of both trends, provoking similar initiatives in other areas of the world, among them East Asia. With respect to commercial space activities, more especially those in the field of space transportation, a similar need for regional and even world-wide co-operation is arising. In order to contribute to the promotion of a balanced regional approach in both civil aviation and outer space activities, the Graduate Institute of European Studies at Tamkang University and the International Institute of Air and Space Law at Leiden University organized a major international conference, entitled The Highways of Air and Outer Space Over Asia, in May 1991. The present work is the result of that conference. It is a collection of articles by the most qualified academics and practitioners from Asia, North America and Europe, covering topical subjects in the field of international civil aviation and outer space activities such as regulatory reform, aviation safety and security, liability in international air transport, the future Euro-Asian aviation relationship, the commercialization of outer space and cooperation between Europe and Asia with respect to outer space activities with special emphasis on the relationships between Asia on the one hand and Europe and the United States on the other.
