Excerpt from The Law Reports, Vol. 9: Court of Erchequer The defendant, who was the father of seven illegitimate children of the plaintiff, agreed with her verbally to pay her 300l. per annum by equal quarterly instalments for so long as she should maintain and educate the children. At the time of the making of the promise the eldest child was about fourteen years old: - Held, that this agreement was not one "not to be performed within a year from the making thereof," within the meaning of the Statute of Frauds, s.4, and was therefore binding, though made by parol only. Per Bramwell and Pigott, Bb.: - the agreement was one which might at any time have been terminated by either party giving notice to the other. The claim in a declaration may be amended, under the Common Law Procedure Act, 1852, s. 222, by the judge at the trial.
