The right of a tailor to keep the coat which he has made from his customer's cloth, until his charges are paid, is such a lien. It is, at common law, a right of detention, not of sale. It presupposes possession of the chattel acquired by the consent of the owner; it cannot begin in a forcible or involuntary dispossession of the owner, by the person asserting it.
