This book challenges the correspondence theory of judicial fact construction – that legal rules resemble and subsume facts ‘out there’ – and instead provides an account of judicial fact construction through legally produced times- or adjudicative temporalities- that structure legal subject and event formation in legal judgement. Drawing on Bergsonian and Gadamerian theories of time, this book details how certain adjudicative temporalities can produce fully willed and autonomous subjects through ‘time framed’ legal events – in effect, the paradigmatic liberal legal subject – or how alternative adjudicative temporalities may structure legal subjects that are situated and constituted by social structures. The consequences of this novel account of legal judgement are fourfold. The first is that judicial fact construction is not exclusively determined by the legal rule (s) but by adjudication’s production of temporalities. The second is that the selection between different adjudicative temporalities is generally indeterminate, though influenced by wider social structures. As will be argued, social structures, framed as a particular type of past produced by certain adjudicative temporalities, may either be incorporated in the rendering of the legal event or elided. The third is that, with the book’s focus on criminal law, different deployments of adjudicative temporalities effect responsibility ascription. Finally, it is argued that the demystification of time as that which structures event and subject formation reveals another way in which to uncover the politics of legal judgement and the potential for its transformative potential, through either its inclusion or its elision of social structures in adjudication’s determination of facts. This book will be of interest to students and scholars in the field of legal judgement, legal theory and jurisprudence.
The Newtonian concept of time has been changed by Einsteinian insight. Yet the Einsteinian world view might make it difficult to appreciate traditional concepts of eschatology, like heaven and hell, death and immortality, life after death and resurrection, last day and final judgments, because these expressions presuppose a pre-Einsteinian view of the universe. Since theology cannot remain unaffected by the new research in concepts of time, Eternity and Eternal Life tries to express the eschatological faith of the Church by using the time language of our age. To achieve this it provides an overview on the research in the nature of time done in geology, cosmology, physics, biology, psychology, sociology, history and philosophy and proposes a notion of time for “timely” Christology and for “timely” eschatology. By using the singularity event as literary form, Horvath scrutinizes how Christ’s time can lead to the times of all existing realities, through death to “eternity.” This is a pioneering work, one that needs to be tested in the community of interested readers. It is a communal search for an understanding of life, death and eternal life, not only in the light of abstract ideas and cultural linguistic doctrines in the world of religions, but also in the light of science and especially of a person as the horizon of understanding for both time and eternity. Chris Schabel presents a detailed analysis of the radical solution given by the Franciscan Peter Auriol to the problem of reconciling divine foreknowledge with the contingency of the future, and of contemporary reactions to it. Auriol's solution appeared to many of his contemporaries to deny God's knowledge of the future altogether, and so it provoked intense and long-lasting controversy; Schabel is the first to examine in detail the philosophical and theological background to Auriol's discussion, and to provide a full analysis of Auriol's own writings on the question and the immediate reactions to them. This book sheds new light both on one of the central philosophical debates of the Middle Ages, and on theology and philosophy at the University of Paris in the first half of the 14th century, a period of Parisian intellectual life which has been largely neglected until now.
This book addresses the issue of natural simultaneity of relatives, discussed by Aristotle in Categories 7, 7b15– 8a12. Natural simultaneity is a form of symmetrical ontological dependence that holds between items that are not causally linked. In this section of the Categories, Aristotle introduces this topic in his analysis of relatives and maintains that although relatives seem to be for the most part simultaneous by nature, there seem to be some exceptions. He mentions two pairs of relatives as exceptions, namely the pairs knowledge/knowable and perception/perceptible, and argues at length for the priority of the second relative over the first one in each case. Through a close reading of this text, the author analyses Aristotle’s arguments for the thesis of the exceptional character of these pairs and shows that all of them are unsuccessful in supporting the thesis. In order to draw this conclusion, the author highlights and carefully considers the properties that Aristotle is committed to attributing to relatives, taking into account the metaphysical framework of the Categories as well as their specificities within the set of nonsubstantial categories. Then, he shows that Aristotle’s mature views on relatives in the Metaphysics can be construed as committing him to the rejection of such a thesis. Although the issue of natural simultaneity is just one of several that Aristotle considers in his discussion of relatives throughout Categories 7, it is a particularly relevant issue, since it involves a number of puzzles whose analysis allows for a better understanding of the very notion of relativity in Aristotle. This is the first book to explore this issue from the perspective of illuminating the Aristotelian views on relatives.
