The current economic and financial crisis erupted several years ago. Its effects impacted deeply upon society, in which legal rules and social patterns have developed to enable the establishment of civilisation, justice and peace. Over time it has become more and more obvious that policy, financial and economic actors have adopted austerity measures as a main tool to solve the ensuing problems, and that these measures have hit social policy standards sometimes dramatically. Recent analyses have dealt with several aspects of this issue. This book focuses on one important element: the impact on collective labour law. It seeks to add to the debate by presenting mainly legal arguments derived from different sources and backgrounds, examining the EU and 'Troika' measures, the economic and political background and the sometimes dramatic consequences of austerity measures on democracy, collective bargaining and the right to strike. Against the framework of EU law, the relevant ILO Conventions, (Revised) European Social Charter and European Convention on Human Rights provisions, the non-compliance of these measures is analysed and demonstrated. The book is also dedicated to procedural questions, and in particular, how legal approaches may be used to challenge austerity measures.
Since World War I, says Joseph McCartin, the central problem of American labor relations has been the struggle among workers, managers, and state officials to reconcile democracy and authority in the workplace. In his comprehensive look at labor issues during the decade of the Great War, McCartin explores the political, economic, and social forces that gave rise to this conflict and shows how rising labor militancy and the sudden erosion of managerial control in wartime workplaces combined to create an industrial crisis. The search for a resolution to this crisis led to the formation of an influential coalition of labor Democrats, AFL unionists, and Progressive activists on the eve of U.S. entry into the war. Though the coalition's efforts in pursuit of industrial democracy were eventually frustrated by powerful forces in business and government and by internal rifts within the movement itself, McCartin shows how the shared quest helped cement the ties between unionists and the Democratic Party that would subsequently shape much New Deal legislation and would continue to influence the course of American political and labor history to the present day.
In May 1919, 30,000 Winnipeg workers walked away from their jobs, shutting down large factories, forcing businesses to close and bringing major industries to a halt. Mounted police and hired security, at the behest of the ruling class, violently ended the protest after six weeks. Two men were killed. What started as trade union revolt, the Winnipeg General Strike became a mass protest and was branded as a revolution. First published in 1983. This study draws upon empirical findings on party activists, members and voters. It examines the origins and nature of Labour’s crisis in the 1980s, showing how the split leading to the formation of the SDP was merely a manifestation of deeply rooted problems which went back many years. It argues that this crisis had three distinct but interrelated aspects: first, the ideological schism within the party, which had grown in intensity over time; second, the electoral crisis, which produced the worst electoral performance at the 1983 general election since 1918; and, third, the membership crisis arising from the fact that the party had been losing more than 11,000 individual members per year on average since 1945. Using elite and mass surveys the book demonstrates the link between these crises and Labour’s policy performance in office set against a background of rapid economic decline.
This book presents a detailed explanation of the essential elements that characterize capital labor relations and the resulting social conflict that leads to repression of labor. It links repression to the class struggle between capital and labor. The starting point involves an historical approach used to explore labor repression after the American Revolution. What follows is an examination of the role of government along with the growth of American capitalism to analyze capital-labor conflict. Subsequent chapters trace US history during the 19th century to discuss the question of the role assumed by the inclusion/exclusion of capital and labor in political-economic structures, which in turn lead to repression. Wholesale exclusion of labor from a fundamental role in framing policy in these institutions was crucial in understanding the unfolding of labor repression. Repression emerges amid a social struggle to acquire and maintain control over policy-making bodies, which pits the few against the many. In response, labor attempts to push back against institutional exclusion in part by the formation of labor unions. Capital reacts to such actions using repression to prevent labor from having a greater role in social institutions. For instance, this is played out inside the workplace as capital and labor engage in a political struggle over the function of the workplace. Given capital’s monopoly of ownership, capital employs various means to repress labor at work, including the introduction of technology, mass firings, crushing strikes, and the use of force to break up unions. The role of the state is not to be overlooked in its support of elite control over production, as well as aiding through legal means the growth of a capitalist economy in opposition to labor’s conception of greater economic democracy. This book explains how and why labor continues to confront repression in the 20th and 21st centuries.
