This book adds a critical perspective to the legal dialogue on the regulation of ‘smart urban mobility’. Mobility is one of the most visible sub-domains of the ‘smart city’, which has become shorthand for technological advances that influence how cities are structured, public services are fashioned, and citizens coexist. In the urban context, mobility has come under pressure due to a variety of different forces, such as the implementation of new business models (e.g. car and bicycle sharing), the proliferation of alternative methods of transportation (e.g. electric scooters), the emergence of new market players and stakeholders (e.g. internet and information technology companies), and advancements in computer science (in particular due to artificial intelligence). At the same time, demographic changes and the climate crisis increase innovation pressure. In this context law is a seminal factor that both shapes and is shaped by socio-economic and technological change. This book puts a spotlight on recent developments in smart urban mobility from a legal, regulatory, and policy perspective. This book provides a comprehensive analysis of the regulatory challenges and legal barriers surrounding the MaaS concept in the EU. By evaluating MaaS against existing EU legal frameworks on data sharing, competition, transport law and beyond, this research seeks to shed light on the regulatory implications of the MaaS concept. It employs a problem-based approach and qualitative doctrinal legal research methodology to assess the potential of MaaS in enhancing the efficiency, accessibility, sustainability, digitalization, multimodality, competitiveness, and convenience of the EU passenger transport sector, while identifying shortcomings in current EU regulatory frameworks that may impede its growth and analysing potential harms that rise of MaaS might cause to competition and users. The book concludes by providing recommendations aimed at enhancing the EU legal frameworks, with the goal of establishing a unified and harmonized framework that promotes an open, competitive, and multimodal MaaS market. We live in a world with an abundance of technologies and the technologies are developing and improving rapidly. Technologies are transforming our lifestyles, social interactions, and workplaces. A technology is considered smart if it performs a task that an intelligent person can do. A smart or intelligent technology is a self-operative and corrective system that requires little or no human intervention. Smart technologies can be understood as a generalization of the concept of smart structures and the use of digital and communications technologies. They have given us new, powerful tools to work. Application of such technologies can transform the conventional cities into smart cities, conventional home into smart home, conventional farming into smart farming, etc. Today, we are in an era where everything is expected to be smart. Common examples include smart cities, smart factory, smart agriculture, smart farming, smart healthcare, smart university, smart medication, smart water, smart food, smart materials, smart devices, smart phones, smart grid, smart energy, smart homes, smart buildings, smart metering, smart appliances, smart equipment, smart heating controls, smart lighting systems, smart watch, smart economy, smart environment, smart grids, smart transportation, smart mobility, smart manufacturing, smart living, smart environment, smart people, etc. These technologies will ensure equity, fairness, and realize a better quality of life. The emergence of sharing mobility is having a profound impact on urban landscapes. In fact, it is deeply affecting the traditional organization of local services by calling into question how urban transportation is planned, and by redesigning city spaces. Further, by connecting people to shared assets, services or both, sharing mobility is poised to facilitate the more efficient use of underutilized resources, becoming a powerful tool for economic growth and social inclusion, while also contributing to sustainability. That being said, the economic, social and spatial impacts of sharing mobility have not been sufficiently investigated, and so far, the evidence is mixed. From a normative standpoint, while it is relevant to better understand the relations between sharing mobility, the city and the environment, it is also of crucial importance to define new policies and sound rules for sharing mobility in urban areas. Against this backdrop, this book adopts a multidisciplinary perspective to explore the role that sharing mobility can play in the creation of more just and sustainable cities.

Mobility justice is one of the crucial political and ethical issues of our day We are in the midst of a global climate crisis and experiencing the extreme challenges of urbanization. In Mobility Justice, Mimi Sheller makes a passionate argument for a new understanding of the contemporary crisis of movement. Sheller shows how power and inequality inform the governance and control of movement. She connects the body, street, city, nation, and planet in one overarching theory of the modern, perpetually shifting world. Concepts of mobility are examined on a local level in the circulation of people, resources, and information, as well as on an urban scale, with questions of public transport and “the right to the city.” On the planetary level, she demands that we rethink the reality where tourists and other elites are able to roam freely, while migrants and those most in need are abandoned and imprisoned at the borders. Mobility Justice is a new way to understand the deep flows of inequality and uneven accessibility in a world in which the mobility commons have been enclosed. It is a call for a new understanding of the politics of movement and a demand for justice for all.
