As part of their regional integration measures, the members of the Association of Southeast Asian Nations (ASEAN) entered a commitment to remove non-tariff barriers and harmonize non-tariff measures by 2015. Despite this, non-tariff measures have steadily increased in the region. This paper examines the non-tariff measure incidence in ASEAN within the context of the structural changes which occurred in the region during the 1990s. The 1990s was a period of tariff liberalization and outward-oriented policies. These marked the transition of these countries from agricultural to increasingly manufacturing countries. The importance of production network-related trade for ASEAN countries makes the rising incidence of non-tariff measures even more noteworthy. On one hand, non-tariff measures can signal the quality of products of processes, thus stimulating demand. On the other hand, non-tariff measures can act as disguised protectionist measures. Are the ASEAN non-tariff measures motivated by a desire to protect industries which are adversely affected by recent structural changes? Or are these non- tariff measures promoting and enhancing these countries' participation in production networks?Using a qualitative approach, this paper examines the trends in the imposition of non- tariff measures vis-à-vis the characteristics of the ASEAN Members. The trends in this region provide evidence for both scenarios. That the rising incidence of non-tariff measures coincided with increased participation in production networks supports the argument that these measures promote trade by signaling quality. However, the incidence of non-tariff measures in declining industries suggest that protectionist motives may be at play. These results imply that the idea that non-tariff measures need to be harmonized and even eliminated to promote trade needs to be reexamined.

The focus of this report is particularly on the consequences of non-tariff measures (NTMs) for developing economies and also South-South trade. This is because (i) barriers to South-South trade need to be tackled if it is to fulfil its potential as a future driver of growth; and (ii) regional developing economies are increasingly the source of new NTMs as well as being their 'victims'. Chapter 1 provides an overview of global and regional trends in trade, tariffs and non-tariff measures and highlights the growing importance of NTMs. Chapter 2 surveys methodological problems that arise when evaluating NTMs and trade. Chapters 3 and 4 consider in more details two of the most prominent and widely-used types of NTM, respectively Sanitary and Phytosanitary (SPS) Measures and Technical Barriers to Trade (TBTs). Chapter 5 concludes by reviewing mechanisms for streamlining NTMs and promoting developing countries' trade, particularly at the regional level

This thesis aims to shed light on the persistence of non-tariff measures in ASEAN (Association of Southeast Asian Nations). It begins with an analysis of the issues on compliance with, and effectiveness of, the region’s international law instruments relating to non-tariff measures. The persistence of non-tariff measures may be due to the trade regime’s inability to provide the Member States with sufficient incentives to comply with their obligations. This is followed by a look into the Member States’ underlying motivations. It is noteworthy that the persistence of non-tariff measures coincided with significant structural changes in the region’s economies. This thesis shows how these structural changes may have influenced the preferences of different actors in the Member States for non-tariff measures. The last part of this thesis builds upon these insights and extends the analysis to an examination of the underlying determinants of trade policy in the region. The results indicate that economic factors do matter. Additionally, the degree of political insulation and accountability may affect how governments respond to these societal preferences, as reflected in laws, policies, and regulations. Thus, non-tariff measures persist in ASEAN because its trade regime failed to overcome the policymakers’ interests in catering to the societal preferences for different kinds of trade measures.

This publication explores how Bhutan could boost its exports by addressing nontariff barriers to trade. It focuses on sanitary and phytosanitary measures and technical barriers to trade, and on export products that have the potential to increase their market share in Bangladesh, India, Maldives, Nepal, and Sri Lanka. It considers options including legal reforms, the upgrade of quality standards and laboratory equipment, and institution building of accrediting bodies and conformity assessment bodies. Practical recommendations suggest ways forward for both the public and private sectors.

This book examines the various issues and concerns faced by Indian agriculture under the obligations of WTO and the Free Trade Agreements. While the issues discussed pertain mainly to India, the lessons can also be derived for many other similarly placed developing countries. The book delves into various aspects of Indian agricultural trade and evaluates the domestic policies and regulations of government while also looking at external factors like WTO, free trade agreements and non-tariff barriers. Chapters of this book have been contributed by eminent agricultural economists, lawyers and social scientists providing the perspective from their sector. This book highlights the challenges and opportunities for agriculture sector under the rapidly growing regional trade agreements and results of negotiations under the WTO. It also provides critical insights into the ongoing fisheries subsidies negotiations at the WTO and issues relating to non-tariff measures. The findings have broad implications for developing countries in general and India in particular. This book will greatly benefit trade negotiators, policymakers, civil society, farmer groups, researchers, students, and academics interested in issues related to the WTO, FTAs, tariff and non-tariff barriers and other allied issues concerning Indian agriculture. The techniques used in analytical part will mostly benefit the researchers as they can not only use these techniques and methodologies for their future research, but to also carry the research forward. The book is useful for many educational institutes which teach international trade, agricultural economics, and WTO and FTAs studies.

This paper explores the impact of reducing non-tariff measures (NTMs) in major ASEAN countries. New econometric estimates of the impact of different types of NTMs are used in a global supply chain model to separately model the effects on intermediate products and those sold to final consumers. We also distinguish between whether the NTM cost burden is directed at exporters or importers. This paper makes important advances in modelling the heterogeneity of NTMs, offering much richer policy analysis of the impact of NTMs on supply chains in the Asia-Pacific region than has previously been possible. We illustrate the benefits, both to the major ASEAN countries and to their trading partners, from the partial liberalisation by ASEAN countries of their most trade distorting types of NTMs. Such liberalisation increases the GDP and welfare of all countries, with the effect particularly pronounced for the major ASEAN countries themselves, especially Vietnam and the Philippines. As trade in plant products and animal products is particularly affected by NTMs, these sectors show the largest expansion of trade.

The Non-Tariff Measures Cost-Effectiveness Toolkit- Handbook for ASEAN is designed to provide ASEAN policy makers a framework to evaluate the effectiveness of NTMs, including some tools and templates. The toolkit is designed on three pillars 0́3 Design, Implementation and Compliance. The Design pillar evaluates how suitable the NTM has been/can be for meeting the stated objectives; Implementation assesses the efficacy of procedures and costs of implementing the NTM; and Compliance measures how burdensome the NTM is on the private sector. The toolkit relies on active engagement with the stakeholders who have to comply with the NTMs and oversee its day-to-day implementation. The goal at all points is to streamline NTMs to achieve public policy objectives at the lowest possible cost.
