The essays in this collection investigate two political traditions and their critical interactions. The first series of essays deals with the development of natural rights individualism, some examining its origins in the thought of the seminal political theorist, John Locke, and the influential constitutional theorist, Montesquieu, others the impact of their theories on intellectual leaders during the American Revolution and the Founding era, and still others the culmination of this tradition in the writings of nineteenth-century individualists such as Lysander Spooner. The second series of essays focuses on the Progressive repudiation of natural rights individualism and its far-reaching effect on American politics and public policy.
This study locates the philosophical origins of the Anglo-American political and constitutional tradition in the philosophical, theological, and political controversies in seventeenth-century England. By examining the quarrel it identifies the source of modern liberal, republican and conservative ideas about natural rights and government in the seminal works of the Exclusion Whigs Locke, Sidney, and Tyrrell and their philosophical forebears Hobbes, Grotius, Spinoza, and Pufendorf. This study illuminates how these first Whigs and their diverse eighteenth-century intellectual heirs such as Bolingbroke, Montesquieu, Hume, Blackstone, Otis, Jefferson, Burke, and Paine contributed to the formation of Anglo-American political and constitutional theory in the crucial period from the Glorious Revolution through to the American Revolution and the creation of a distinctly American understanding of rights and government in the first state constitutions.

. Renewal of Life by Transmission. The most notable distinction between living and inanimate things is that the former maintain themselves by renewal. A stone when struck resists. If its resistance is greater than the force of the blow struck, it remains outwardly unchanged. Otherwise, it is shattered into smaller bits. Never does the stone attempt to react in such a way that it may maintain itself against the blow, much less so as to render the blow a contributing factor to its own continued action. While the living thing may easily be crushed by superior force, it none the less tries to turn the energies which act upon it into means of its own further existence. If it cannot do so, it does not just split into smaller pieces (at least in the higher forms of life), but loses its identity as a living thing. As long as it endures, it struggles to use surrounding energies in its own behalf. It uses light, air, moisture, and the material of soil. To say that it uses them is to say that it turns them into means of its own conservation. As long as it is growing, the energy it expends in thus turning the environment to account is more than compensated for by the return it gets: it grows. Understanding the word "control" in this sense, it may be said that a living being is one that subjugates and controls for its own continued activity the energies that would otherwise use it up. Life is a self-renewing process through action upon the environment.

Spinoza's Theological-Political Treatise (1670) is one of the most important philosophical works of the early modern period. Richard Hofstadter, the distinguished historian and twice winner of the Pulitzer Prize, brilliantly assesses the ideas and contributions of the three major American interpretive historians of the twentieth century: Frederick Jackson Turner, Charles A. Beard and V.L. Parrington.
