Excerpt from Law Relating to Literary Copyright and the Authorship and Publication of Books The Law of Copyright has reference to the various subjects of Literature, Art, Music, and the Drama. It was assumed, when deciding upon the scope of the present work, that of the branches referred to the greater number of questions or matters that come before either the Courts or the profession relate to Copyright in Literature. It was thought, moreover, that other subjects, being closely allied to it (inasmuch as they relate generally to the authorship and publication of books), might conveniently be treated in conjunction with the subject of Literary Copyright. The primary object of this volume has therefore been to collect the law generally relating to the authorship and publication of books. Literary Copyright being treated fully (to the exclusion of other branches of copyright law), but at the same time rather as a portion of the wider general subject than as a main and particular theme. Excerpt from Copyright, Its Law and Its Literature: Being a Summary of the Principles and Law of Copyright, With Especial Reference to Books Property right in unpublished works has never been effectively questioned - a fact which in itself confirms the view that intellectual property is a natural inherent right. The author has preme control over an unpublished work, and his manuscript cannot be utilized by creditors as assets without his consent. If he lends a copy to another, says Baron Parks, his right is not gone; if he sends it to another under an im plied undertaking that he is not to part with it or publish it he has a right to enforce that undertaking. The receiver of a letter, to whom the paper containing the writing has un doubtedly been given, has no right to publish or otherwise use 'the letter without the writer's consent. The theory that by permitting copies to be made, an author dedicates his writing to the public, as an owner of land dedicates a road to the public by permitting public use of it for twenty-one years, overlooks the fact that in so doing the author only conveys to each holder of his book the right to individual use, and not the right to multiply copies, as though the landowner should not give but sell permission to individuals to pass over his road, without any permission to them to sell tickets for the same privilege to other people. The owner of a right does not forfeit a right by selling a. Privi lege. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. The notion of the author as the creator and therefore the first owner of a work is deeply rooted both in our economic system and in our concept of the individual. But this concept of authorship is modern. Mark Rose traces the formation of copyright in eighteenth-century Britain—and in the process highlights still current issues of intellectual property. Authors and Owners is at once a fascinating look at an important episode in legal history and a significant contribution to literary and cultural history.

First published in 1992, Authorship and Copyright traces the history of constructions of authorship as a legal reality. It offers an alternative to the two mainstream interpretations that have traditionally been assigned to authorship: the Romantic dialectical ‘birth of the author’ or the language-based post-structuralist ‘death of the author.’ Saunders examines the shortcomings of both schemes by arguing that they impose an arbitrary philosophical direction on the history of authorship and the law of copyright. Saunders addresses the issues relating to copyright and the construction of authorship as a legal status. Combining information and polemic, the author explores such matters as the historical and theoretical relations of copyright and the droit moral, the aestheticization of the law and the juridification of aesthetics, and the argument that authorship as a legal reality is a historically contingent and variable arrangement that cannot be separated from its cultural and juridical context. This book will be of interest to students of law, literature and philosophy.
