Whereas Volume 1, subtitled Magistrates, Media and the Masses, analysed the establishment, development and practice of police courts, Volume 2, subtitled Boundaries, Behaviours and Bodies, examines, through themed case studies, how these civic and judicial institutions shaped conceptual, spatial, temporal and commercial boundaries by regulating every-day activities, pastimes and cultures. As with Volume 1, Boundaries, Behaviours and Bodies is attentive to the relationship between magistrates, the police, the media and the wider community, but here the main focus of analysis is on the role and impact of the police courts, through their practice, on cultural ideas, social behaviours and environments in the nineteenth-century city. By intertwining social, cultural, institutional and criminological analyses, this volume examines police courts’ external impact through the matters they treated, considering how concepts such as childhood and juvenile behaviour, violence and its victims, poverty, migration, health and disease, and the regulation of leisure and trade, were assessed and ultimately affected by judicial practice.
The book covers the period from 1812, when the Tron Riot in Edinburgh dramatically drew attention to the ‘lamentable extent of juvenile depravity’, up to 1872, when the Education Act (Scotland) inaugurated a system of universal schooling. During the 1840s and 1850s in particular there was a move away from a punitive approach to young offenders to one based on reformation and prevention. Scotland played a key role in developing reformatory institutions – notably the Glasgow House of Refuge, the largest of its type in the UK – and industrial schools which provided meals and education for children in danger of falling into crime. These schools were pioneered in Aberdeen by Sheriff William Watson and in Edinburgh by the Reverend Thomas Guthrie and exerted considerable influence throughout the United Kingdom. The experience of the Scottish schools was crucial in the development of legislation for a national, UK-wide system between 1854 and 1866.

Scotland is probably the only sovereign nation to have chosen, in a more or less free vote, to surrender its independence in order to merge with a larger, more powerful, neighbour. For most of the period since the Union of 1707 the Scots were enthusiastic partners with England in creating and administering the British Empire. Inevitably, therefore, the end of empire caused an identity crisis in Scotland. For more than a Century pressure for political home rule produced no tangible result; however, the decisive vote in favour of devolution in the referendum of September 1997 means that a restored Scottish Parliament is now likely to be in place by the millennium. Irrespective of political developments, the last two decades have seen a renaissance in Scottish culture and historiography. Rates of female delinquency, especially for violent crimes, are increasing in most common law countries. At the same time the growth in cyber-bullying, especially among girls, appears to be a related global phenomenon.While the gender gap in delinquency is narrowing in Australia, United States, Canada and the United Kingdom, boys continue to dominate the youth who commit crime and have a virtual monopoly over sexually violent crimes. Indigenous youth continue to be vastly over-represented in the juvenile justice system in every Australian jurisdiction. The Indigenisation of delinquency is a persistent problem in other countries such as Canada and New Zealand.Young people who gather in public places are susceptible to being perceived as somehow threatening or riotous, attracting more than their share of public order policing. Professional football has been marred by repeated scandals involving sexual assault, violence and drunkenness. Given the cultural significance of footballers as role models to thousands, if not millions, of young men around the world, it is vitally important to address this problem. A number of inquiries in Australia and the United Kingdom have since established that children committed to these institutions, supposedly for their own good, experienced systemic physical, sexual and psychological abuse during their institutionalisation.
