The prevalence of the sexual abuse of children by Catholic clergy and its shocking cover-up by church officials have obscured the largely untold story of the tort system's remarkable success in bringing the scandal to light. The lessons of clergy sexual abuse litigation give us reason to reconsider the case for tort reform and to look more closely at how tort litigation can enhance the performance of public and private policymaking institutions.
The Catholic church is many things: a sign and instrument of Christ; a gathering of flawed human beings; a mystery. It is, in some ways, unlike any other organization in the world; yet it is, nevertheless, an organization: as St John Henry Newman observed, “it has developed according to the laws under which combinations of men develop.” Over the past century, a body of knowledge has emerged concerning how to create “healthy”, effective organizations. The Charter for the Protection of Children and Young People is a comprehensive set of procedures originally established by the USCCB in June 2002 for addressing allegations of sexual abuse of minors by Catholic clergy. The Charter is also a helpful resource to inform lay Catholics as to the measures the Church in the United States has implemented, since 2002, to prevent abuse, hold offenders accountable, and offer healing to survivors.
