Updated as of May 29, 2018 This final rule implements addenda to add exemptions from certain Federal fishing regulations to some or all Northeast (NE) multispecies sector operations plans that were previously approved by the final sector rule published April 9, 2010. That rule approved FY 2010 sector operations plans and contracts for, and made allocations of Annual Catch Entitlements (ACE) to, 17 sectors in the NE multispecies fishery. In addition, this action approves an exemption functionally equivalent to the Gulf of Maine (GOM) Haddock Sink Gillnet Pilot Program for FY 2010 sectors (proposed in Amendment 16 to the NE Multispecies Fishery Management Plan (FMP) for both common pool and sector vessels, but disapproved by NMFS), since this program would be more controlled for sectors and unlikely to compromise efforts to eliminate overfishing and rebuild overfished stocks. The exemptions are intended to provide additional flexibility and improve profitability for sector vessels. "Due to the interrelated nature of impacts resulting from the operation of sectors, and exemptions to fishery regulations, NMFS agreed to prepare the required NEPA documentation to accompany the sector operations plans it has or expects to receive for fishing year (FY) 2015-2020. Fishing years for the Northeast Multispecies fishery run from May 1 to April 30 (e.g., FY 2015 is May 1, 2015 through April 30, 2016. "This action partially approves, and implements, 19 Northeast (NE) multispecies (groundfish) sector operations plans and contracts for fishing year 2012, and allocates quotas of NE multispecies to the sectors. This action does not approve certain exemptions and measures proposed in the operations plans. "The National Marine Fisheries Service (NMFS) prepared this analysis to evaluate potential impacts that would result from the approval of additional exemptions for each of the 17 fishing year (FY) 2013 Multispecies sector operations plans and complimentary changes to the American Lobster Fishery Management Plan (FMP). In accordance with the National Environmental Policy Act (NEPA), this Environmental Assessement (EA) presents impact information on the physical, biological, habitat, and socio-economic ecosystem components that would result in the approval of additional exemptions described herein. As of May 1, 2013, NMFS has approved a total of 17 sectors to operate according to their sectorspecific operations plans under an Annual Catch Entitlement (ACE). A sector is defined as a group of persons holding limited access vessel permits who have voluntarily entered into a contract and agree to certain fishing restrictions for a specified period of time, and which has been granted an ACE in order to achieve objectives consistent with applicable fisheries management plan (FMP) goals and objectives. In the formation of a sector, sector participants can select who could participate (NEFMC 2009). An ACE is defined as the amount of each allocated groundfish stock (in pounds) that a sector can harvest in a fishing year. All other groundfish vessels that are not associated with a sector operate under Common Pool rules, which, among other restrictions, generally control fishing mortality by limiting the number of days-at-sea (DAS)"--Introduction (page 13).
