This text focuses on guiding employers, managers, labour relations practitioners, trade unions and students alike in understanding and applying the provisions of South Africa's latest employment equity legislation - the Employment Equity Act 55 of 1998.
The purpose of this guide is to help employers understand their legal obligations regarding the duty to accommodate, and to create their own workplace accommodation policies and procedures. Employers will then be in a better position to provide an inclusive workplace and to minimize the likelihood of complaints of discrimination. The guide sets out the elements of a model policy on workplace accommodation; explains how to set up a procedure for analyzing employer programs and activities in order to ascertain if a program or activity will give rise to discriminatory barriers; describes a procedure for responding to requests from a specific employee for individual accommodation.
