Le terme “Service” a orienté les travaux de recherche et de formation lors du XIIIème Congrès de l'Association Internationale de Formation et de Recherche en Education Familiale (AIFREF). Il s'agissait, en l'occurrence, de se mettre au service de la petite enfance. L'acte qui consiste à se consacrer au service d'un être qui chemine sur la voie de l'autonomie a pris une consistance et une importance sans cesse croissantes au cours du développement de la modernité. Aujourd'hui, celle-ci connaît une profonde mutation : entrant dans la postmodernité, nous constatons que la notion de service prend un tout autre sens. Pour mieux être au service de l'enfance, il s'agit maintenant de savoir ce qui peut lui être utile. Qu'est-ce qui permet à l'enfant de grandir et de s'émanciper? Et, dès lors, quels services convient-il de rendre à l'enfance? Quelles sont la relevance, l'efficience, l'efficacité et la durabilité de ces services délibérément conçus et opérationnalisés? This book is about how work enters and affects the lives of children in Africa, taking for granted neither the traditional values surrounding childrens work, nor the international standards against it. Many African societies nurture their children on the ingrained notion that children must work as part of their process of growing up. Children participate in their families and communities through the work they do in the house and in whatever else their families do. Such views are, however, antithetical to the dominant views in Europe and North America which see childhood as a time of freedom from responsibility and economic activity. These views have become so popular with the elites in other countries to the extent that they now drive international campaigns against child labour, and have been incorporated into what are now considered universal international standards and conventions. This book was conceived within the framework of the CODESRIA tradition of taking African perspectives seriously and not allowing social research in Africa to become subservient to values from outside. African scholars remain keenly aware of the need not to isolate themselves from developments in the wider world, which could lead to stagnation. This book, through empirical observation of the lives of African children, the work they do, its place in their lives, and what the children say about it, proposes new perspectives towards a new understanding of this complex stage of human development. Work is not simply about the right to income: work provides identity and status in society, and participation in the community. People relate to one another through work. Those who do not work are often without status and are at the periphery of society. One of the major ways in which this book differs from most of the available literature is in the understanding it brings to the problem of child labour. There are economic reasons why children may need an income of their own. There is the demographic fact that the proportion of children to adults in low-income countries is nearly double that in high-income societies. This book attempts to demonstrate that work is both necessary and beneficial in terms of a childs development to become a full, responsible, and respectable member of society.

The basic aim of this special issue is to focus on the profound change of tendency in education that is taking place at both the national and interna tional level. At a time when education and lifelong learning are increasingly merging into one process, it is important to examine the ways in which edu cational policies and practices are evolving. Increasing numbers of children are on the move throughout the world: moving or migrating, alone or accompanied. This gives rise to many new problems with legal, economic, social and cultural aspects, calling for new approaches based on a world-wide perspective. The international mobility of children poses a special challenge for the protection of their family environment, as guaranteed by the United Nations Convention on the Rights of the Child and other international instruments. This volume presents global and comparative perspectives on the perpetual pendular movement of family law between status and contract. It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014.
