Excerpt from Dual System of Rapid Transit for New York City It is true that the courts later decided against the Comptroller and the appropriation was subsequently authorized, but the ensuing litigation consumed more than a year and postponed the beginning of work on the Fourth Avenue Subway from May, 1908, until November, 1909. The fact that the City's financial officer had to appeal to the courts to determine whether the debt limit restriction would permit an appropriation of showed that the City had so closely approached the debt limit that, even with the normal increase in real estate values each year, it could not hope to expand the margin sufficiently within the time necessary to build such rapid transit lines as the necessities of the situation demanded.
