Real actions, as they are seldom resorted to in the present day, are not included within the design of this treatise; and the only mixed action, which will be considered, is the action of Ejectment. The other class, consisting of personal actions. Is far the most numer ous, and these are usually divided into such as are founded on tort or wrong, independently of any contract. Of the first kind, the actions, here treated of, are actions of as sumpsit, covenant, and debt. Of the latter kind, are se tions on the Case, Replevin, and Trespass. Only a few of this class of actions on the Case have been selected for discussion; those selected are the actions for Defamation.
