What is a right? What, if anything, makes rights different from other features of the normative world, such as duties, standards, rules, or principles? Do all rights serve some ultimate purpose? In addition to raising these questions, philosophers and jurists have long been aware that different senses of ‘a right’ abound. To help make sense of this diversity, and to address the above questions, they developed two types of accounts of rights: models and theories. This book explicates rights modelling and theorising and scrutinises their methodological underpinnings. It then challenges this framework by showing why the theories ought to be abandoned. In addition to exploring structural concerns, the book also addresses the various ways that rights can be used. It clarifies important differences between rights exercise, enforcement, remedying, and vindication, and identifies forms of legal rights-claiming and rights-invoking outside of institutional contexts.
To those who invoke them, rights are powerful instruments for settling arguments in favour of the right-holders. But the nature, provenance and justification of rights are uncertain and disputed and there are doubts about whether rights should play a distinctive and fundamental role in moral and political discourse. More recent disgreements have centred on group rights and on whether rights have a universal application across different cultures and moral traditions. These and other related issues are explored in depth by the essays in this volume, which are mostly drawn from a wide range of journals in philosophy, politics and law.

The theory of justice is one of the most intensely debated areas of contemporary philosophy. Most theories of justice, however, have only attained their high level of justification at great cost. By focusing on purely normative, abstract principles, they become detached from the sphere that constitutes their “field of application” - namely, social reality. Axel Honneth proposes a different approach. He seeks to derive the currently definitive criteria of social justice directly from the normative claims that have developed within Western liberal democratic societies. These criteria and these claims together make up what he terms “democratic ethical life”: a system of morally legitimate norms that are not only legally anchored, but also institutionally established. Honneth justifies this far-reaching endeavour by demonstrating that all essential spheres of action in Western societies share a single feature, as they all claim to realize a specific aspect of individual freedom. This book makes two important contributions toward a general and systematic theory of rights-a powerful philosophical analysis of the language of rights and an explanation of the nature of rights. In working out these ideas, Wellman has provided a new and cohesive way of thinking and talking about rights of every sort. Wellman succeeds in bringing all kinds of rights-moral, legal, institutional, etc.-under one unified theory in a way that illuminates their similarities and differences. This enables him to deal in a consistent way with a very broad range of philosophical questions, questions that are too often dealt with in isolation from each other.
John Leslie Mackie (1917-1981) was one of the most influential philosophers of the twentieth century. His published works spanned many areas, but he is not well known as a political philosopher. In the late 1970s, however, Mackie turned his attention to issues concerning justice. In a series of writings, Mackie built a case for a unique right-based approach to political philosophy, in part by delivering incisive critiques of theories dominant at the time. His most comprehensive work in this area is Theories of Justice and Rights--a previously unpublished manuscript that finally sees the light of day in this volume. Also included are two of Mackie's previously published papers, written during the same period: 'Can There Be a Right-Based Moral Theory?' (1978) and 'Rights, Utility, and External Costs' (1985). Some of Mackie's arguments in these works draw on the metaethical conclusions in his seminal book Ethics: Inventing Right and Wrong (1977). The editorial introduction canvasses the initially puzzling relation between Mackie's moral error theory and his account of justice and rights, addresses some exegetical queries, and connects to present-day debates.
