This book looks at the multidisciplinary aspects of the legal, economic, and scientific aspects of deep-sea mining, whilst, providing a rich historical background on the work and progress of the International Seabed Authority over the last 25 years of its existence.
Volume VI is the sixth substantive volume to be published in the series. It deals with the work of the First Committee at the Third UN Conference on the Law of the Sea, namely the international seabed area. The volume thus embraces the deep seabed mining regime set out in Part XI of the 1982 Convention on the Law of the Sea together with the 1994 Agreement on its implementation. Completion of this commentary was delayed first by the consultations and negotiations that commenced in 1990 and led to the 1994 Agreement and the entry into force of the Convention. It was further delayed until the Assembly of the International Seabed Authority approved the detailed mining regulations in 2000. This is the seventh and final volume of the most authoritative reference on the Third United Nations Convention on the Law of the Sea (UNCLOS III, 1973-1982). The volume provides the original text of the 1982 convention as fully integrated with the provisions of the 1994 Agreement on the Implementation of XI, in addition to an extensive subject index to Volumes I through VI of the series.
On October 7, 1994, President Clinton transmitted to the Senate the 1982 United Nations Convention on the Law of the Sea and the 1994 Agreement relating to the Implementation of Part XI of the United Nations Convention. The package was referred to the Senate Committee on Foreign Relations. On November 16, 1994, the U.N. Law of the Sea Convention entered into force but without accession by the United States. The 1994 Agreement entered into force on July 28, 1996, again without U.S. ratification.
The "1994 Rhodes Papers," beginning with a foreword by Sir Robert Y. Jennings, member and former President of the International Court of Justice, offer a collection of contributions dealing with the negotiations and events leading to the entry into force of the UN Convention on the Law of the Sea. The volume also includes contributions of key participants from the Third United Nations Conference on the Law of the Sea, the subsequent work of the Preparatory Commission, and the Secretary-General's consultations adjusting Part XI of the convention. The collection is based on presentations made during the annual seminar of the Center for Oceans Law and Policy (University of Virginia School of Law), held in May 1994, at Rhodes, Greece. Topics include: UN efforts to adjust Part XI and perspectives thereon; legal effects of entry into force for parties and nonparties; consideration of the Convention by the U.S. Senate; and current fisheries issues in relation to the Convention.
The United Nations Convention on the Law of the Sea is the international regime over the seabed and the ocean floor entered into force 12 years later, on 16 November 1994. The Agreement relating to the implementation of Part XI of the Convention was adopted on 28 July 1994 and entered into force on 28 July 1996. This Agreement and Part XI of the Convention are to be interpreted and applied together as a single instrument.
This Study was prepared by the Secretariat of the International Seabed Authority to provide a summary of the International Workshop on Further Consideration of the Implementation of Article 82 of the United Nations Convention on the Law of the Sea (the Convention), which was held in Beijing, China, from 26 to 30 November 2012 (Beijing Workshop), in collaboration with the China Institute for Marine Affairs (CIMA). The Workshop aimed to draw up recommendations for Article 82 implementation guidelines and the outline of a model Article 82 agreement between the ISA and an outer continental shelf (OCS) State for receiving payments and contributions. The workshop also considered the framework, process and criteria for the equitable distribution by the Authority of payments and contributions. These recommendations are intended to form the basis for further consideration of the issues associated with the implementation of Article 82 by the relevant organs of the Authority in 2013 and beyond.
