This book describes and analyzes the conceptual ambiguity of vulnerability, in an effort to understand its particular applications for legal and political protection when relating to groups. Group vulnerability has become a common concept within legal and political scholarship but remains largely undertheorized as a phenomenon itself. At the same time, in academia and within legal circles, vulnerability is primarily understood as a phenomenon affecting individuals, and the attempts to identify vulnerable groups are discredited as essentialist and stereotypical. In contrast, this book demonstrates that a conception of group vulnerability is not only theoretically possible, but also politically and legally necessary. Two conceptions of group vulnerability are discussed: one focuses on systemic violence or oppression directed toward several individuals, while another requires a common positioning of individuals within a given context that conditions their agency, ability to cope with risks and uncertainties, and manage their consequences. By comparing these two definitions of group vulnerability and their implications, Macioce seeks a more precise delineation of the theoretical boundaries of the concept of group vulnerability.

The protection of vulnerable groups varies under international human rights law. Depending on the group at stake, protection may be more or less advanced. In some cases, the international community has deemed it necessary to adopt conventions providing for the rights of certain vulnerable groups and establishing mechanisms to verify State compliance. Other groups have not been the focus of States’ standard-setting endeavours, but their protection still falls within the scope of human rights treaties of general application and the mandate of their respective monitoring bodies. This book takes an innovative approach to the investigation of the international legal protection of vulnerable groups. Rather than examining the situation of a number of vulnerable groups and applicable international or regional conventions, this book reviews the overall scope of the protection of vulnerable groups under International Human Rights Law. For the past decade, humanitarian actors have increasingly sought not only to assist people affected by conflicts and natural disasters, but also to protect them. At the same time, protection of civilians has become central to UN peacekeeping operations, and the UN General Assembly has endorsed the principle that the international community has the "responsibility to protect" people when their governments cannot or will not do so. Elizabeth Ferris explores the evolution of the international community's understandings of protection, with a particular emphasis on the humanitarian community. "Protection" is a noble word, with positive connotations, but what does it actually mean in practice? Does providing assistance to vulnerable people protect them, for example? Does monitoring the number of rapes protect women? Does increased engagement in protection activities by humanitarian agencies jeopardize the cornerstone humanitarian principles of neutrality and impartiality? In The Politics of Protection, Ferris examines inconsistent ways in which protection is defined and applied. For example, why do certain groups receive international protection while other equally needy groups do not? Vulnerability and resistance have often been seen as opposites, with the assumption that vulnerability requires protection and the strengthening of paternalistic power at the expense of collective resistance. Focusing on political movements and cultural practices in different global locations, including Turkey, Palestine, France, and the former Yugoslavia, the contributors to Vulnerability in Resistance articulate an understanding of the role of vulnerability in practices of resistance. This book compares how the social consequences of climate change are similarly unevenly distributed within China and the United States, despite different political systems. Focusing on the cases of Atlanta, USA, and Jinhua, China, Julia Teebken explores a set of path-dependent factors (lock-ins), which hamper the pursuit of climate adaptation by local governments to adequately address the root causes of vulnerability. Lock-ins help to explain why adaptation efforts in both locations are incremental and commonly focus on greening the environment. In both these political systems, vulnerability appears as a core component along with the reconstitution of a class-based society. This manifests in the way knowledge and political institutions operate. For this reason, Teebken challenges the argument that China’s environmental authoritarian structures are better equipped in dealing with matters related to climate change. She also interrogates the proposition that certain aspects of the liberal democratic tradition of the United States are better suited in dealing with social justice issues in the context of adaptation. Overall, the book’s findings contradict the widespread assumption that developed countries necessarily have higher adaptive capacity than developing or emerging economies.
