Based on the example of the Polish delegation to the European Parliament, the book examines the factors influencing the cohesion and stability of EP national delegations. It takes into account the impact of institutional arrangements such as the electoral law and the candidate selection process, the ideological and programmatic profiles of political parties, the career paths of MEPs, affiliation to political groups in the EP, group switching, as well as the significance of Euroscepticism and national divisions transferred to the European level. It is not a typical case study, as the regularities discovered through the in-depth analysis of the Polish national delegation are compared with those characteristic of other national delegations in the EP. The book fills a gap in studies devoted to the EP, in which the importance of national delegations has not so far been the subject of thorough analyses.
The book represents original research in a field of study rarely pursued while analysing the intellectual dimensions of disputes over ethically sensitive issues that occur in European Union politics. These disputes are generally analysed at ideological, ethical, economic and interstate levels. However, these references do not suffice in understanding the issue, which is related to a divergent perception of the essence of humanity and thus the subject matter of anthropology. The main research objective of the monograph is therefore to reconstruct the sources and the specific European Union way of thinking about the human being. Methodologically, the book expands the understanding of political anthropology within political science and presents a range of suitable instruments for pursuing anthropological research. At the theoretical level, it proposes an anthropological typology of the main currents of European political thought and reveals their prominence for the anthropological orientation of the EU's axiology. Empirically, it provides an analysis of the anthropological features of European Union institutions and policies in addition to discussing the relation between the axiological and anthropological positions of the main political and national groups within the EU.
This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. Why Noncompliance traces the history of noncompliance within the European Union (EU), focusing on which states continuously do or do not follow EU Law, why, and how that affects the governance in the EU and beyond. In exploring the EU's long and varied history of noncompliance, Tanja A. Börzel takes a close look at the diverse groups of noncompliant states throughout the EU's existence. Why do states that are vocally critical of the EU have a better record of compliance than those that support the EU? Why has noncompliance been declining since the 1990s, even though the EU was adding member-states and numerous laws? Börzel debunks conventional wisdoms in EU compliance research, showing that noncompliance in the EU is not caused by the new Central and Eastern European member states, nor by the Eurosceptic member states. So why do these states take the brunt of Europe's misplaced ire? Why Noncompliance introduces politicization as an explanatory factor that has been long overlooked in the literature and scholarship surrounding the European Union. Börzel argues that political controversy combined with voting power and administrative capacity, explains why noncompliance with EU law has been declining since the completion of the Single Market, cannot be blamed on the EU's Central and Easter European member states, and is concentrated in areas where EU seeks to protect citizen rights. This book offers a comprehensive overview of the role of parliamentary administrations in the control of European Union policy-making. It questions whether the decision to give parliaments greater powers in the aftermath of the Lisbon Treaty had only the intended effect of political debate on European policies, or whether it has also resulted in the bureaucratisation of parliaments. The authors argue that the challenges of information-management faced by parliaments lead them to delegate an extensive set of tasks to their administrations. They offer a broad empirical picture, analysing the challenges faced by national parliaments and the role and response of their administrations in the case of the European Parliament, national parliaments and regional parliaments. In addition, the book studies the interaction between different administrations and their contribution to interparliamentary cooperation. It presents a new and different perspective on the challenges and dynamics of multi-level parliamentarism.
Moving from a social movement perspective, this timely volume examines narratives on Euroscepticism and frames on Europe from below, at the party and social movement levels. Revealing perspectives from both the Right and the Left, it unpacks the emergence, re-emergence and increase in critical ‘voices’ and opposition towards Europe. Based on extensive fieldwork in two candidate countries for accession to the EU and three member states, it offers insight from analysis of focus groups, interviews with Eurosceptic and pro-European political actors and ordinary citizens, together with frame analysis and scrutiny of archival material, electoral manifestoes and organisational documents. Revealing the development of Eurocritical frames, it demonstrates the differences and similarities in narratives used to address Europe and the conceptualisation of Euroscepticism. Key cases examined include the rise of illiberalism in post-transition Slovenia; complex Euroscepticism in Poland; the path from strong support to harsh opposition in Italy; indecision over membership in North Macedonia; anticipating the future while revisiting the past in Bosnia and Herzegovina. The European Conservatives and Reformists (ECR) are now established as one of the larger groups in the European Parliament and from 2014 to 2019 had more MEPs than the Liberals, Greens or radical left and right-wing factions. Despite this, ECR has so far been largely dismissed by political scientists, journalists and Brussels policy-makers as merely another Euro-sceptic faction. Representing the first major study of the political activities of ECR and its ‘Euro-realist’ agenda, this book argues that ECR ought to be recognised as the main voice for Conservatism in Strasbourg, promoting ‘Anglosphere’ free market values and the role of NATO in international relations. The book begins with an examination of the origins and early development of ECR, when British Conservative leader David Cameron established the group in a Euro-sceptic gesture to his party. Cameron failed, however, to see the isolating long-term consequences of withdrawing his MEPs from the powerful European People’s Party (EPP). Other chapters examine the role of ECR member parties in its development and profile – including Law and Justice (PiS) from Poland, the Czech Civic Democrats (ODS), the New Flemish Alliance (N-VA) and the Danish People’s Party (DF). Drawing on interviews with MEPs and other key figures, the book concludes with an analysis of the leadership and policy activities of ECR politicians in Brussels and Strasbourg in an attempt to measure influence.
