The intention, indeed, has been, to include in the present edition every special proceeding recognized by the statutes of this State. The werk, it will be seen, has been increased in size much beyond that of the first edition. This was rendered necessary by the insertion of the new proceedings referred to; proceedings which will be found to be of such importance and value to the profession, as to more than compensate for any inconvenience arising from the increased size of the work. Excerpt from The Law and Practice in Special Proceedings, 1869, Vol. 2 of 2 In respect to the Superior Court Of the city of New York, although jurisdiction in these proceedings was conferred upon it, in part, by sec. 21, Of chapter 470, of the Laws of 1847 (g). 641) and which has not in terms been repealed, yet, it seems, the question of jurisdiction is so doubtful that that court will not entertain jurisdiction to issue a commission in lunacy. 1 Abb. Excerpt from Practice in Special Proceedings in the Courts of Record of the State of New York, Vol. 1 of 2: Under the Code and Consolidated Laws, With Forms The first edition contained 745 pages, the second edition pages. The present edition, by condensation of authorities and omission of precedents in cases where printed forms can be readily obtained, as in summary proceedings and supplementary proceedings, and by reason of the largely increased size of the page, has with difficulty been kept within the limit of pages. It will be noted that in the consolidation many of the proceedings have been transferred from the Code to the Statutes. In such cases tabular statements are made indicating the former Code section and the statute and section where now found. The cyclopedic arrange ment will be found to facilitate the work of investigation in that each of the unconnected topics will be found in its alphabetical order. To this an exception is made in treating Special Proceedings Gren erally which is introductory in its nature and therefore precedes the specific topics ranged under that general title. Acknowledgment is due and very cheerfully tendered to Hon. Ledyard P. Hale, counsel to the Public Service Commission, Second District, for most valuable advice and assistance in connection with precedents in use by that Commission, and to Louis M. Martin and Wilber W. Chambers, who have, as Deputy attorneys-general, been in charge of that department, for selection and revision of precedents in proceedings for Voluntary Dissolution of Corporations.
