Excerpt from The Federal Reporter, Vol. 105: Cases Argued and Determined in the Circuit Courts of Appeals and Circuit and District Courts of the United States; January 1901-March, 1901 The respective statements of fact must be printed at the begin ning of the briefs; and, in discussing the evidence, giving the rea sons why the facts proposed should or should not be regarded as es tablished, the briefs of each counsel shall follow the order adopted in the said statements of fact respectively, supporting first his own propositions, and afterwards attacking the propositions of his op ponente. Each brief shall also contain a separate and distinctly enumerated statement of the legal propositions relied ou, supported by such arguments and citation of authorities as counsel may deem appropriate; but the legal arguments shall, as far as possible, pur sue the order of the statements of fact. The counsel on both sides may at any time before final hearing, by written stipulation filed with the clerk, agree upon the reference of the issues in the case to a master, and may agree by such stipula tion that the person selected shall also act as examiner.
