Almost two decades ago, the fall of the Santer Commission against a background of allegations of maladministration and nepotism had the effect of placing accountability on the political agenda of the EU institutions. More recently, the non-ratification of the Constitutional Treaty, the difficulties of the ratification of the Lisbon Treaty and the current financial crisis have increased the calls for accountability in the EU. This book investigates whether any progress towards more accountability and transparency has been made in the post-Lisbon era by taking a holistic approach to the subject. Marios Costa argues that currently the EU institutions and the Member States are not in a position to hold the so-called independent agencies as well as the various committees and expert groups accountable. Despite recent progress, the EU still needs to put forward an acceptable constitutional framework which will truly secure accountability at the EU level of governance.

The implications of European integration for national democracy and constitutionalism are well known. Nevertheless, as the events of the last decade made clear, the EU's complex system of governance has been unable to achieve a democratic or constitutional legitimacy in its own right. In Power and Legitimacy: Reconciling Europe and the Nation-State, Peter L. Lindseth traces the roots of this paradox to integration's dependence on the postwar constitutional settlement of administrative governance on the national level. Supranational policymaking has relied on various forms of oversight from national constitutional bodies, following models that were first developed in the administrative state and then translated into the European context. These national oversight mechanisms (executive, legislative, and judicial) have over the last half-century developed to address the central disconnect in the integration process: between the need for supranational regulatory power, on the one hand, and the persistence of national constitutional legitimacy, on the other. In defining the ways European public law has sought to reconcile these two conflicting demands, Professor Lindseth lays the foundation for a better understanding of the "administrative, not constitutional" nature of European governance going forward.

Over the last twenty years, the role of national parliaments in EU affairs has gained considerable academic attention. Much of the literature, however, has focused on parliamentary scrutiny and control in EU affairs. What tends to be generally overlooked is that the parliamentary communication function is at least as important in EU politics as the control function. Democratic legitimacy depends on a vibrant public debate on political solutions and alternatives to allow citizens to make informed political (electoral) choices and to exercise democratic control. Within the EU, it is precisely the opacity of policy-making processes and the lack of public discourse that have been defined as core problems of democratic legitimacy. Here, parliaments have the potential to provide an ideal arena for the deliberation of important European issues and thus to help overcome the much-lamented distance between European policy processes and the citizens. Yet, despite parliaments' central relevance for the legitimacy of European politics, the parliamentary communication function remains so far under researched. This book discusses the European Union’s approach to governance reform in its development assistance relationships with various groups of developing countries.
