Excerpt from Reports Upon Railway Commissions Railway Rate Grievances and Regulative Legislation Complaints arising under the Act of 1854 and subsequent Acts, with reference to matters of rates and equal facilities, might come before the Commission either upon the initiative of the party aggrieved or upon a certificate of the Board of Trade alleging that there had been a violation of the Acts in question, or upon complaint of some person authorized to institute proceedings by the Board of Trade. In hearing complaints and in enforcing decisions the Commission was to have the power conferred upon the courts and judges, in regard to such matters, under the Act of 1854, and of issuing similar writs and orders. Except, in so far as the courts were called upon to enforce the decisions of the Commission, they were to cease to exercise the jurisdiction conferred upon them by the Act of 1854. When a complaint was instituted against a railway or canal company the Commission might before instituting formal proceedings, communicate with such company so that it might make a rejoinder. Excerpt from Railway Legislation: The Railway Companies and the Railway Commissioners, Proposed Transfer to the Commissioners of the Power of Fixing Rates on Railways and Repeals of Existing Parliamentary Rates, Letters and Correspondence Whereas by Section 11 of The Regulation of Railways Act, 1873, it is enacted that the facilities therein mentioned shall include the due and reasonable receiving, forwarding, and delivering by every Railway Company and Canal Company, and Railway and Canal Company, at the request of any such other Company, of through trafiic to or from the Railway or Canal of any other such Company, at through rates. And whereas it is expedient to amend and enlarge the said enactment: Be it therefore Enacted, That, from and after the passing of this Act, the said facilities shall include the due and reasonable receiving, for warding, and delivering by every Railway Company and Canal Company, and Railway and Canal Company, at the request of any other such Company, or on the application of any number of not less than ten persons interested or aggrieved, of through traffic at through rates; and the sub-sections from 1 to 9, inclusive, of the 11th section, so far as they are applicable, and, mutatis mutandis, shall apply to the said persons making such application. Excerpt from Report of the Joint Special Committee on Railroad and Street Railway Laws To the Honorable Senate and House of Representatives: - I. Introduction. The committee was appointed under the following joint order of the General Court of the year 1905: - Ordered That a joint special committee, to consist of four members of the Senate and eleven members of the House, be appointed to sit during the recess of the General Court, to revise, consolidate and arrange the general laws of the Commonwealth pertaining to railroad and street railway corporations, and to consider the expediency of such legislation in amendment thereof and in addition thereto as will better protect the interests of the public and of the investors in said corporations. This order is in terms very broad. It empowers the committee "to revise, consolidate and arrange the general laws of the Commonwealth pertaining to railroad and street railway corporations," and also "to consider the expediency of such legislation in amendment thereof and in addition thereto as will better protect the interests of the public and of the investors in said corporations." Were the committee to comply literally with the terms of this order, it would be obliged to deal with the whole subject of the railroad and street railway legislation of the Commonwealth, and all the intricate and difficult problems that that legislation presents. It became apparent at once to the committee that it would be impossible for it to undertake any such comprehensive task. It has therefore limited the scope of its inquiry, and also of its action.
