Na primeira subparte deste capítulo, Fernando Azevedo vai analisar o que chama de “equilíbrio mínimo” da relação jurídica de consumo e o “princípio do equilíbrio (ou da equivalência material) no CDC” (4.1). E na segunda subparte (4.2) o autor analisa situações de desequilíbrio excessivo da relação de consumo e a necessária tutela jurídica dos consumidores pelo CDC, em especial os incidentes e acidentes de consumo, a perda da equivalência econômica pela onerosidade excessiva superveniente, o direito à revisão e à resolução dos contratos de consumo; o que denomina “exercício irregular da posição jurídica dos fornecedores”, isto é, as práticas abusivas e finaliza (4.3) analisando o superendividamento”.
