This book considers the impact of the Trans-Pacific Partnership [TPP] on intellectual property and trade. The book focuses upon the debate over copyright law, intermediary liability, and technological protection measures. The text examines the negotiations over trade mark law, cybersquatting, geographical indications and the plain packaging of tobacco products. It explores the debate over patent law and access to essential medicines, data protection and biologics, and the protection of trade secrets. In addition, the book investigates the treatment of Indigenous intellectual property, access to genetic resources, and plant breeders’ rights.
In February 2016, twelve Pacific Rim countries signed the agreement on the Trans Pacific Partnership (TPP), one of the largest and most comprehensive trade deals in history. While there are several estimates of the likely effects of the TPP, there is no systematic study on the effects on all Latin American countries. We present the results from applying a multi-sector model with perfect competition presented by Costinot and Rodriguez-Clare (2014). The exercise, based on input-output data for 189 countries and 26 sectors, shows that (i) Asian TPP members are estimated to benefit most from the agreement, (ii) negative spillovers to non-TPP LAC countries appear to be of a different order of magnitude than the gains of members, and (iii) some non-TPP LAC countries may experience relatively large benefits from joining the TPP. As a cautionary note, however, we point out that even a cursory cross-study comparison shows that there is considerable uncertainty regarding the potential effects of the TPP for both members and non-members.
The United States and 11 other countries from both sides of the Pacific are currently negotiating the Trans-Pacific Partnership (TPP). The agreement is expected to set new benchmark for international trade through its comprehensive coverage of issues and binding regulations. It is expected to eventually mature into a regional trade agreement covering the entire Asia-Pacific. As of now, it does not include China and India, the two largest emerging markets and regional economies. The TPP has generated controversy for its excessive emphasis on trade issues, which have remained unresolved or unaddressed at the WTO due to differences between developed and emerging markets. It has also been criticized for adopting a negotiating style reflecting the US regulatory approach to international trade and also as a geo-political strategy of the US for supporting its strategic rebalancing towards Asia. From both economic and geo-political perspectives, the TPP has various significant implications for China and India that are examined in the book. This book sheds light on how China and India's entries in the TPP are mutually beneficial and how both countries can gain from the TPP by gaining preferential access to large markets and using it as an opportunity for introducing more outward-oriented reforms. The book also cautions that US must reconcile to the rebalancing of economic power within the grouping that will occur following the entries of China and India. Otherwise, the TPP and China and India might walk divergent paths and trade and regional integration in Asia-Pacific may not ever converge. The Trans-Pacific Partnership (TPP) talks attempt to link together at least nine countries in three continents to create a 'high-quality, twenty-first century agreement'. Such an agreement is intended to open markets to competition between the partners more than ever before in sectors ranging from goods and services to investment, and includes rigorous rules in the fields of intellectual property, labour protection and environmental conservation. The TPP also aims to improve regulatory coherence, enhance production supply chains and help boost small and medium-sized enterprises. It could transform relations with regions such as Latin America, paving the way to an eventual Free Trade Area of the Asia Pacific, or see innovations translated into the global trade regulatory system operating under the WTO. However, given the tensions between strategic and economic concerns, the final deal could still collapse into something closer to a standard, 'twentieth-century' trade agreement.
