Excerpt from The Mysore Law Reports, 1893, Vol. 16: Containing Cases Determined by the Chief Court of Mysore, the Court of the Judicial Commissioner of Coorg and the Court of the British Resident in Mysore The courts below dismissed the suit on the grounds 1) that defendant No. 1's application for certificate was not preferred within three years from the date of confirmation and was barred under the Limitation Act, sch. II, art. 178; (2) that the property was sold in execution of another decree and pur chased by defendant N o. 2 in 1888, which was prior to the date of the certificate (24th January 1890) (3) that on the date of the certificate, there was no title to vest in defendant N o 2, and, therefore, the plaintiff acquired no title by reason of the sale by defendant N o. 1.
