The purpose of this book is to set out the fundamental principles governing the law of medical malpractice in clear and understandable terms, so that those principles can be applied in daily practice. The intersection of the fields of medicine and the law produces formidable challenges. For the lawyer, the applicable legal principles and issues are as intellectually and professionally demanding as encountered in any field of the law. For the medical practitioner, there is at present an obstructive uncertainty and anxiety about the legal rules which apply, and the health professions accordingly feel under siege. Added to this is the formative role that government and civil society plays in considering and assimilating into our legal system profound policy considerations affecting our most intimate interests. This book addresses these issue clearly and comprehensively.
As legal jurisdictions in the Global South, both India and South Africa have long histories of inequality and structural oppression. This book engages in comparative sociolegal analysis to examine the contours of social justice in both countries. It explores the role of law as an instrument for social change in the face of persistent conditions of injustice, discrimination, social exclusion, and socioeconomic vulnerabilities. The book addresses newly emerging socio-legal challenges for the social justice continuum in a neoliberal era. Focusing on four key themes, it explores: · the challenges for labour law and social security including informalisation, climate change, and migrancy; · law, technology, and social justice, with a focus on the role that emerging technologies often play to ameliorate or exacerbate social exclusion; · sexual orientation, gender, and substantive equality, grappling with the disjuncture between law and lived realities; and · pedagogical approaches to legal education and social justice lawyering. This book discusses the teaching of ‘legal ethics’, arguing that the current formal rules governing lawyers are inadequate, as true engagement with ethical issues requires lawyers to exercise judgment, and therefore there is a need to rethink the aims, scope and methodology of ‘legal ethics education. The volume presents the views of a number of internationally renowned legal ethicists, including Brent Cotter and David Chavkin, exploring and questioning the teaching of legal ethics. The contributions examine legal ethics teaching in a range of jurisdictions including the USA, Canada, Australia, South Africa and Hong Kong. A number of contributors discuss design issues that cover a broad field of methods, including simulations, the pervasive use of problem-solving exercises, and real-world experiences, with some of the essays revealing their empirical findings on the effectiveness of these methods and particularly as they affect the students.

About the publication I am delighted to present to you, the reader, the fifteenth edition of the Pretoria Student Law Review (PSLR) with its Special Section on ‘Social Justice and COVID-19’. This year’s Annual Edition, together with the developments made during the year, is a testament to the growth, resilience, and adaptability of this student-driven initiative especially during these turbulent times. This year has also been one of reflection and remembrance as we publish this edition in tribute to the late Professor Christof Heyns whose instrumentality in the establishment of the Pretoria University Law Press (PULP) has brought us to where we are today. Fourteen years since its inception and the PSLR still continues to grow and evolve whilst remaining true to its thriving legacy in fostering excellence and innovation through legal writing. This publication’s uniqueness is also presented through its diverse contributions all addressing contemporary societal and legal issues under a broad range of legal disciplines. In an era of many continued ‘firsts’, the PSLR has strived to build on the legacy of its predecessors by expanding on the Journal’s visibility and accessibility. The PSLR’s digital presence has now grown substantially leading to an increase in quality submissions from institutions across the country. This year, the PSLR launched its first independent website and developed an official logo for the Journal and its online platforms. Authors are now able to submit their papers through the Open Journals System platform, track their workflow, manage their submissions, and submit at any time outside of the PSLR’s official call for submissions. We can firmly submit that we have, in pursuance of being a DHET accredited journal, fulfilled the standards set out by the Department of Higher Education and Training. Recent financial crisis and the global financial impacts of the COVID-19 pandemic have brought renewed interest to the regulation and practice of corporate insolvency and restructuring. Modernisation of the insolvency profession, and the regulation of its practitioners, is a contemporary concern and recent years have seen significant reforms of insolvency law. The success of such reforms can be enhanced through a clear understanding of difficulties faced by the insolvency profession in achieving successful restructuring and insolvency outcomes and through the determination of effective solutions to those difficulties. However, there is limited empirical data to inform the day-to-day practice of insolvency, nor the difficulties experienced by insolvency practitioners in pursing insolvency and restructuring solutions. This book addresses this absence of data and understanding, examining the role and practice of corporate insolvency practitioners and exploring the challenges that they encounter.
