The South African Truth and Reconciliation Commission (TRC) was set up to deal with the human rights violations of apartheid. However, the TRC's restorative justice approach did not always serve the needs of communities at a local level. Based on extended anthropological fieldwork, this book illustrates the impact of the TRC in urban African communities in Johannesburg. It argues that the TRC had little effect on popular ideas of justice as retribution. This provocative study deepens our understanding of post-apartheid South Africa and the use of human rights discourse.

This work is a meditation on the shaping of time and its impact on living with and understanding atrocity in South Africa in the wake of the Truth and Reconciliation Commission (TRC). It is an examination of the ways that the institutionalization of memory has managed perceptions of time and transition, of events and happenings, of sense and emotion, of violence and recovery, of the past and the new. Through this process a public language of memory has been carved into collective modes of meaning. It is a language that seems deprived of the hopes, dreams, and possibilities for the promise of a just and redemptive future it once nurtured.Truth commissions are profoundly implicated in the social politics of memorialization. Memory, as a conceptual, historical, and experiential discourse about the past, relates to the ways in which cruelty is integrated into societal understandings, which include cognitive and philosophic frameworks and constructions of social meaning. The politics of historical truth, of memory and of justice, play out in unintended ways. There is not only the ongoing struggle for survivors of state terror, but also the ways that the everyday shapings of silences, the emptiness of reconciliation and the fracturing of hope remain embedded in political life.
The South African Truth and Reconciliation Commission was a noble attempt to begin to address the continuing traumatic legacy of Apartheid. This interdisciplinary collection critiques the work of the TRC 20 years since its establishment. Taking the paralysing political and social crises of the mid-1990s in South Africa as starting point, the book contains a collection of responses to the TRC that considers the notions of crisis, judgment and social justice. It asks whether the current political and social crises in South Africa are linked to the country’s post-apartheid transitional mechanisms, specifically, the TRC. Over the last fifteen years, the South African postapartheid Transitional Amnesty Process – implemented by the Truth and Reconciliation Commission (TRC) – has been extensively analyzed by scholars and commentators from around the world and from almost every discipline of human sciences. Lawyers, historians, anthropologists and sociologists as well as political scientists have tried to understand, describe and comment on the ‘shocking’ South African political decision to give amnesty to all who fully disclosed their politically motivated crimes committed during the apartheid era. Investigating the postapartheid transition in South Africa from a multidisciplinary perspective involving constitutional law, criminal law, history and political science, this book explores the overlapping of the postapartheid constitution-making process and the Amnesty Process for political violence under apartheid and shows that both processes represent important innovations in terms of constitutional law and transitional justice systems. Both processes contain mechanisms that encourage the constitution of the unity of the political body while ensuring future solidity and stability. From this perspective, the book deals with the importance of several concepts such as truth about the past, publicly shared memory, unity of the political body and public confession.

This book explores the practice of traumatic storytelling that emerged out of the South African Truth and Reconciliation Commission and came to play a key role in the lives of the members of the Khulumani Support Group for victims of apartheid-era political violence. Group members found traumatic storytelling both frustrating and yet also an important form of memory work that shaped how they saw themselves in the post-apartheid era. Drawing on ethnographic fieldwork, the author examines how traumatic storytelling functioned not only as a kind of psychological healing and national political theatre, but also as a potent form of social relation, economic exchange, political activism, and expressive practice. With emphasis on the personal, social, and political significance of the act of traumatic storytelling, this volume asks why members of Khulumani, despite their many disappointments, continued to engage intensively in storying their experiences for themselves and others. Examining what powers storytelling held for both group members and their witnesses, and considering the ways in which storytelling enabled new senses of self and new understandings of what was possible in the years after the end of apartheid, this book considers what we might learn more broadly from the experiences of Khulumani about the possibilities—and limits—of traumatic-memory-making as an instrument of personal, social, and political repair. As such, it will appeal to scholars of sociology, anthropology, and criminology with interest in justice and post-conflict societies.
Justice and Reconciliation in Post-Apartheid South Africa assesses the transitional processes under way since the early 1990s to create a stable and just society. Change in South Africa is often credited to the efforts of the Truth and Reconciliation Commission (TRC), but the work of this institution forms but a facet of a much broader picture. This book looks at the steps which accompanied and followed the TRC's activities, such as land restitution, institutional reforms and social and cultural initiatives. Thematically, it interlinks the TRC's concerns over truth and reconciliation with an analysis of the concepts of justice, accountability, harm and reconciliation and with competing perceptions of what these notions entail in the South African context. Bringing together international and South African scholars whose work has focused on these themes, the contributions provide a cohesive and inspiring analysis of South Africa's response to its unjust past.
