This book studies the normative intersection between integration, immigration and nationality in the European Union (EU). It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy.
Understanding the dynamics of the illiberal practices of liberal states is increasingly important in Europe today. This book examines the changing relationship between immigration, citizenship and integration at the European and national arenas. It studies some of the main effects and questions the comprehensiveness of the exchange and coordination of public responses to the inclusion of third country nationals in Europe, as well as their compatibility with a common European immigration policy driven by a rights-based approach and the respect of the principles of fair and equal treatment of third country nationals. The volume reviews key national experiences of immigration and citizenship laws, the use of integration and the 'moving of ideas' between national arenas. The framing of integration in immigration and citizenship law and the ways in which policy convergence is being achieved through the EU framework on integration raises a number of conceptual dilemmas and a set of definitional premises in need of reflection and consideration.
"The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. This book offers the first empirical and holistic analysis of the design, implementation and effects of the new naturalisation regimes in the United Kingdom and Germany introduced in the 2000s. Based on a multi-sited state ethnography, it uniquely compares the law on the books, the local administration, and the lived experiences of citizenship tests, courses, and ceremonies from an interdisciplinary social science perspective. The book argues that naturalisation procedures in both countries suggest to migrants to constantly optimise themselves in the state’s interests toward the subjectivity of the “Super Citizen” – a political, economic, and cultural asset to the liberal-democratic, capitalist nation-state. The concept of the Super Citizen enables us to highlight and criticise the overburdening expectations toward citizens by application as opposed to citizens by birth. The analysis reveals that the self-presentation of Britain and Germany as liberal and meritocratic polities is in stark contrast to migrants’ lived experiences of the naturalisation process. By shedding light on naturalisation policies’ efficacy, this book is aimed at students and scholars in sociology, politics, law, anthropology, and education, as well as policy-makers in the areas of citizenship and migration.
This highly original book provides an innovative analysis of EU migration and asylum law and its interplay with equality issues in order to assess the current integration framework for third-country nationals and to explore future scenarios in the European Context. Integration for Third-Country Nationals in the European Union focuses on the nexus between non-discrimination based on nationality and race, and the equality clauses covering different categories of regularly residing third-country nationals within EU law. Language and integration tests as a condition for naturalisation and various types of legal residence permits are topical issues in several European Member States. The introduction of the tests reflects a change in ideas on the relationship between legal status and integration. Since the introduction of the tests is a rather recent development, little is known of the effects of the formalised testing schemes. Whether the tests have in fact contributed to the integration of immigrants in the host society or whether they function as a mechanism for selection and exclusion is unknown. In this book, experts from Austria, Belgium, Denmark, France, Germany, Hungary, Latvia, the Netherlands and the United Kingdom analyse the policies concerning the integration of newcomers and/or future citizens in their countries.
The book presents the results of several qualitative research project with different actors that put migration policies into practice. It shows the different ways in which day-to-day activities of organisations shape migration policies on the ground. This book offers a comprehensive exploration on how different migration policies are implemented day by day. Such an approach allows to show the different ways in which migration policies on the ground take a life of their own when compared to the letter of the law. The book shows the need to understand the specific logics and workings of the implementation of policies, while taking into account the continued role played by politicians and the judiciary, non-state actors and migrants. Qualitative research with different public institutions implementing migration policies are combined with an exploration of the role of NGOs, supranational institutions and the migrants themselves. Bringing together the results of several research projects with fieldwork in Belgium, the UK, France, Morocco and Malta, the book covers the different stages of the migratory career. It follows the potential trajectory of a migrant from visa obtention (both in general and for students specifically) to border controls, asylum (including resettlement and gender and sexuality-based asylum), access to residence (with a specific focus on marriage-based residence), healthcare and nationality, or to detention and managed return migration. Through its chapters it shows the day-to-day logics, routines and tactics that bureaucrats and other actors adopt, within the constrains of laws, social interactions, and ideas about policies.
