EU commitment to human rights policies has grown following the Lisbon Treaty. Taking stock of those developments, this book describes the framework, actors, policies, and strategies of human rights across the EU and how their impact is felt. Contributed to by scholars from across the EU, this provides an in-depth and holistic view of the issues.
Migration is one of the greatest societal challenges of our time. It has many facets, from mass movements to escape war, climate, or human rights abuses to the search for economic opportunity and prosperity. Illicit industries facilitate border crossings at the expense of safety, and governments face problems of processing and integrating new arrivals. These challenges have had a profound impact in Europe, calling into question central values of solidarity and human rights. This book analyses the law and policy of migration in the European Union (EU) and its relationship to understandings of the EU as an international human rights actor. It examines the role crisis plays in determining the priorities of migration policy and the impact political exigencies have on the rights of migrants. This book problematises the EU Area of Freedom, Security, and Justice as a ‘home.’ Taking a governmentality approach to critique discourse, the idea of a holistic approach is deconstructed to explore notions of wellness, resilience, responsibilisation and externalisaton. The EU’s pursuit of a holistic approach to managing migration in crisis indicates problems with EU solidarity, and the tactics employed to bring the crisis under control reveal security concerns that provoke questions about the EU as an international human rights actor. Both this framework for analysis and the empirical findings make a significant contribution to how the migration crisis can be theorised using adaptable conceptual tools. Under this form of governance, migration becomes a phenomenon to be treated so that its symptoms are ameliorated. This book will be of interest to students and scholars of the EU, migration, and human rights as well as policymakers, commentators, and activists in these areas.
We are at a point in history where economic inequalities are more widespread each day. The situation of extreme poverty experienced by the majority of the populations in developing countries ("Third World" countries) often coincides with an absence of democracy and the violation of the most fundamental rights. But in so-called "First World" countries a non-negligible proportion of inhabitants also live in impoverished conditions (albeit mainly "relative" poverty) and are denied their rights. The European situation, which this publication aims to analyse, is painful: the entire continent is afflicted by increasing poverty and consequently by the erosion of living conditions and social conflicts.The economic and financial crisis has resulted in the loss of millions of jobs, and created job insecurity for many still working. Economic insecurity raises social tensions, aggravating xenophobia, for instance. Yet the economic and financial crisis could present a good opportunity to rethink the economic and social system as a whole. Indeed, poverty in modern societies has never been purely a question of lack of wealth. It is therefore urgent today to devise a new discourse on poverty. In pursuit of this goal, the Council of Europe is following up this publication in the framework of the project "Human rights of people experiencing poverty", co-financed by the European Commission.
The state-centred 'Westphalian model' of international law has failed to protect human rights and other international public goods effectively. Most international trade, financial and environmental agreements do not even refer to human rights, consumer welfare, democratic citizen participation and transnational rule of law for the benefit of citizens. This book argues that these 'multilevel governance failures' are largely due to inadequate regulation of the 'collective action problems' in the supply of international public goods, such as inadequate legal, judicial and democratic accountability of governments vis-a-vis citizens. Rather than treating citizens as mere objects of intergovernmental economic and environmental regulation and leaving multilevel governance of international public goods to discretionary 'foreign policy', human rights and constitutional democracy call for 'civilizing' and 'constitutionalizing' international economic and environmental cooperation by stronger legal and judicial protection of citizens and their constitutional rights in international economic law. Moreover intergovernmental regulation of transnational cooperation among citizens must be justified by 'principles of justice' and 'multilevel constitutional restraints' protecting rights of citizens and their 'public reason'. The reality of 'constitutional pluralism' requires respecting legitimately diverse conceptions of human rights and democratic constitutionalism. The obvious failures in the governance of interrelated trading, financial and environmental systems must be restrained by cosmopolitan, constitutional conceptions of international law protecting the transnational rule of law and participatory democracy for the benefit of citizens.
The two-sub themes of this Ministerial Conference were gender equality as an integral part of human rights in a democratic society, and gender analysis and gender budgeting: tools for economic development. The main objective of the Conference was to raise awareness, at the highest political level, to the fact that the lack of gender equality implies personal, social and economic costs higher than the cost of those incurred in implementing gender equality and that there are social and economic benefits to be gained from its implementation. These proceedings present the main contributions to the Conference as well as the two following texts adopted by the European ministers responsible for gender equality: Resolution on Achieving gender equality: a challenge for human rights and a prerequisite for economic development and Action Plan for Achieving gender equality in all spheres of society.--Publisher's description.

The Convention on Preventing and Combating Violence against Women and Domestic Violence (CETS No. 210) is the first legally binding instrument to address violence against women and domestic violence in Europe. It contains a wide range of obligations aiming to prevent violence, protect its victims, prosecute the perpetrators, implement coordinated policies and promote international co-operation. It also envisages a monitoring mechanism. The convention recognizes violence against women as a violation of human rights and is a major step forward in achieving gender equality in law and in fact.
