The America of the early republic was built on an experiment, a hopeful prophecy that would only be fulfilled if an enlightened people could find its way through its past and into a future. Americans recognized that its promises would only be fully redeemed at a future date. In Revolutionary Prophecies, renowned historians Robert M. S. McDonald and Peter S. Aboriginal title represents one of the most remarkable and controversial legal developments in the common law world of the late-twentieth century. Overnight it changed the legal position of indigenous peoples. The common law doctrine gave sudden substance to the tribes' claims to justiciable property rights over their traditional lands, catapulting these up the national agenda and jolting them out of a previous culture of governmental inattention. In a series of breakthrough cases national courts adopted the argument developed first in western Canada, and then New Zealand and Australia by a handful of influential scholars. By the beginning of the millennium the doctrine had spread to Malaysia, Belize, southern Africa and had a profound impact upon the rapid development of international law of indigenous peoples' rights. This book is a history of this doctrine and the explosion of intellectual activity arising from this inrush of legalism into the tribes' relations with the Anglo settler state. The author is one of the key scholars involved from the doctrine's appearance in the early 1980s as an exhortation to the courts, and a figure who has both witnessed and contributed to its acceptance and subsequent pattern of development. He looks critically at the early conceptualisation of the doctrine, its doctrinal elaboration in Canada and Australia - the busiest jurisdictions - through a proprietary paradigm located primarily (and constrictively) inside adjudicative processes. He also considers the issues of inter-disciplinary thought and practice arising from national legal systems' recognition of aboriginal land rights, including the emergent and associated themes of self-determination that surfaced more overtly during the 1990s and after. The doctrine made modern legal history, and it is still making it.

This book explores the deep roots of modern democracy, focusing on geography and long-term patterns of global diffusion. Its geographic argument centers on access to the sea, afforded by natural harbors which enhance the mobility of people, goods, capital, and ideas. The extraordinary connectivity of harbor regions thereby affected economic development, the structure of the military, statebuilding, and openness to the world – and, through these pathways, the development of representative democracy. The authors' second argument focuses on the global diffusion of representative democracy. Beginning around 1500, Europeans started to populate distant places abroad. Where Europeans were numerous they established some form of representative democracy, often with restrictions limiting suffrage to those of European heritage. Where they were in the minority, Europeans were more reticent about popular rule and often actively resisted democratization. Where Europeans were entirely absent, the concept of representative democracy was unfamiliar and its practice undeveloped.
Many would rather change worlds than change the world. The settlement of communities in 'empty lands' somewhere else has often been proposed as a solution to growing contradictions. While the lands were never empty, sometimes these communities failed miserably, and sometimes they prospered and grew until they became entire countries. Building on a growing body of transnational and interdisciplinary research on the political imaginaries of settler colonialism as a specific mode of domination, this book uncovers and critiques an autonomous, influential, and coherent political tradition - a tradition still relevant today. It follows the ideas and the projects (and the failures) of those who left or planned to leave growing and chaotic cities and challenging and confusing new economic circumstances, those who wanted to protect endangered nationalities, and those who intended to pre-empt forthcoming revolutions of all sorts, including civil and social wars. They displaced, and moved to other islands and continents, beyond the settled regions, to rural districts and to secluded suburbs, to communes and intentional communities, and to cyberspace. This book outlines the global history of a resilient political idea: to seek change somewhere else as an alternative to embracing (or resisting) transformation where one is.
In 2012, Cambodia—an epicenter of violent land grabbing—announced a bold new initiative to develop land redistribution efforts inside agribusiness concessions. Alice Beban's Unwritten Rule focuses on this land reform to understand the larger nature of democracy in Cambodia. Beban contends that the national land-titling program, the so-called leopard skin land reform, was first and foremost a political campaign orchestrated by the world's longest-serving prime minister, Hun Sen. The reform aimed to secure the loyalty of rural voters, produce "modern" farmers, and wrest control over land distribution from local officials. Through ambiguous legal directives and unwritten rules guiding the allocation of land, the government fostered uncertainty and fear within local communities. Unwritten Rule gives pause both to celebratory claims that land reform will enable land tenure security, and to critical claims that land reform will enmesh rural people more tightly in state bureaucracies and create a fiscally legible landscape. Instead, Beban argues that the extension of formal property rights strengthened the very patronage-based politics that Western development agencies hope to subvert.
Existing studies of settler colonial genocides explicitly consider the roles of metropolitan and colonial states, and their military forces in the perpetration of exterminatory violence in settler colonial situations, yet rarely pay specific attention to the dynamics around civilian-driven mass violence against indigenous peoples. In many cases, however, civilians were major, if not the main, perpetrators of such violence. The focus of this book is thus on the role of civilians as perpetrators of exterminatory violence and on those elements within settler colonial situations that promoted mass violence on their part.
Colonialism: A Global History interprets colonialism as an unequal relationship characterised by displacement and domination, and reveals the ways in which this relationship has been constitutive of global modernity. The Invisible Hand? offers a radical departure from the conventional wisdom of economists and economic historians, by showing that 'factor markets' and the economies dominated by them — the market economies — are not modern, but have existed at various times in the past. They rise, stagnate, and decline; and consist of very different combinations of institutions embedded in very different societies. These market economies create flexibility and high mobility in the exchange of land, labour, and capital, and initially they generate economic growth, although they also build on existing social structures, as well as existing exchange and allocation systems. The dynamism that results from the rise of factor markets leads to the rise of new market elites who accumulate land and capital, and use wage labour extensively to make their wealth profitable. In the long term, this creates social polarization and a decline of average welfare. As these new elites gradually translate their economic wealth into political leverage, it also creates institutional sclerosis, and finally makes these markets stagnate or decline again. This process is analysed across the three major, pre-industrial examples of successful market economies in western Eurasia: Iraq in the early Middle Ages, Italy in the high Middle Ages, and the Low Countries in the late Middle Ages and the early modern period, and then parallels drawn to England and the United States in the modern period. These areas successively saw a rapid rise of factor markets and the associated dynamism, followed by stagnation, which enables an in-depth investigation of the causes and results of this process.
