A Brookings Institution Press and Visions of Governance for the 21st Century publication Advances in information technology are transforming democratic governance. Power over information has become decentralized, fostering new types of community and different roles for government. This volume—developed by the Visions of Governance in the 21st Century program at the Kennedy School of Government—explores the ways in which the information revolution is changing our institutions of governance. However, power need not involve the exercise of force or compulsion; people often obey because they think it is in their interest to do so, they have no reason to disobey or they fear punishment. Above all, people obey their government because it has authority; its power is seen by people as rightfully held, as legitimate. People can grant their government legitimacy because they have been socialized to do so; because there are processes, such as elections, that enable them to choose and change their rulers; and because they believe that their governing institutions operate justly. Politics is the process by which leaders are selected and policy decisions are made and executed. It involves people and groups, both inside and outside of government, engaged in deliberation and debate, disagreement and conflict, cooperation and consensus and power struggles. Transparency and citizen engagement remain essential to good government and sound public policy. Indeed, they may well be the key to restoring trust in government itself, currently at an all-time low in Australia. It is ironic, then, that this has occurred at a time when the technological potential for information dissemination and interaction has never been greater. Opening Government: Transparency and Engagement in the Information Age explores new horizons and scenarios for better governance in the context of the new information age, focusing on the potentials and pitfalls for governments (and governance more broadly) operating in the new, information-rich environment. This book examines the impact of current and emerging digital technologies on global environmental governance, and in particular on environmental civil society organizations. Technological innovations are constantly emerging: internet and social media platforms, blockchains, big data, and artificial intelligence are some of the most common or promising digital technologies of our times. Through case studies and the analysis of concrete applications of digital technologies, this book shows how these digital technologies can be deployed to support global environmental governance, and in particular a multi-stakeholder approach to the protection of the environment. It provides an overview of the diverse uses of these digital technologies by civil society organizations (CSOs) in global environmental governance. In this fast-changing context, the capacity of environmental CSOs to manage and benefit from digital technologies, and to produce and distribute information, can strengthen their participation in global environmental governance. Their key roles, including advocacy, monitoring, knowledge production, fundraising, nudging individual behaviors, and project implementation, greatly benefit from the use of these technologies. By examining some of the most-utilized current digital technologies and presenting some of the most prominent emerging ones, this book aims to illustrate how active civil society organizations operate, and how ICTs support some of their roles, and therefore their participation in global environmental governance. The case for a smarter “prosumer law” approach to Internet regulation that would better protect online innovation, public safety, and fundamental democratic rights. Internet use has become ubiquitous in the past two decades, but governments, legislators, and their regulatory agencies have struggled to keep up with the rapidly changing Internet technologies and uses. In this groundbreaking collaboration, regulatory lawyer Christopher Marsden and computer scientist Ian Brown analyze the regulatory shaping of “code”—the technological environment of the Internet—to achieve more economically efficient and socially just regulation. They examine five “hard cases” that illustrate the regulatory crisis: privacy and data protection; copyright and creativity incentives; censorship; social networks and user-generated content; and net neutrality. The authors describe the increasing “multistakeholderization” of Internet governance, in which user groups argue for representation in the closed business-government dialogue, seeking to bring in both rights-based and technologically expert perspectives. Brown and Marsden draw out lessons for better future regulation from the regulatory and interoperability failures illustrated by the five cases. They conclude that governments, users, and better functioning markets need a smarter “prosumer law” approach. Prosumer law would be designed to enhance the competitive production of public goods, including innovation, public safety, and fundamental democratic rights.
