The Law Library presents the complete text of the Fisheries of the Northeastern United States - Northeast Multispecies Fishery - 2011 Sector Operations Plans and Contracts (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 This interim final rule partially approves and implements 19 sector operations plans and contracts for fishing year (FY) 2011. NMFS received sector operations plans and contracts from the following 22 sectors: The Georges Bank (GB) Cod Fixed Gear Sector; the Maine Permit Bank Sector; the Massachusetts Permit Bank Sector; the New Hampshire Permit Bank Sector; the Northeast Coastal Communities Sector; Northeast Fishery Sectors II through XIII; the Port Clyde Community Groundfish Sector; the Rhode Island Permit Bank Sector; Sustainable Harvest Sectors 1 and 3; and the Tri-State Sector. This interim final rule partially approves the operations plans and contracts, and allocates an annual catch entitlement (ACE) of certain NE multispecies stocks to the following 19 sectors: The GB Cod Fixed Gear Sector; the Maine Permit Bank Sector; the Northeast Coastal Communities Sector; Northeast Fishery Sectors II through XIII; the Port Clyde Community Groundfish Sector; Sustainable Harvest Sectors 1 and 3; and the Tri-State Sector. The Massachusetts Permit Bank Sector, the New Hampshire Permit Bank Sector, and the Rhode Island Permit Bank Sector, were unable to fulfill the roster requirements, and, therefore, were not approved to operate in FY 2011. Certain exemptions proposed in the operations plans have not been approved, as explained in detail below. Additionally, NMFS is modifying, for the purposes of this rule, the definition for "unmarketable" fish (see Exemption 11) and will accept further comment on this definition. NMFS is also accepting further comment on final sector membership. NMFS will publish a subsequent final rule, if necessary, making any further changes to this definition or in light of additional comments on changes to membership of sectors since the publication of this rule. This ebook contains: - The complete text of the Fisheries of the Northeastern United States - Northeast Multispecies Fishery - 2011 Sector Operations Plans and Contracts (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition) - A dynamic table of content linking to each section - A table of contents in introduction presenting a general overview of the structure

The Law Library presents the complete text of the Fisheries of the Northeastern United States - Multispecies Fishery - 2012 Sector Operations Plans and Contracts (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 This final rule partially approves, and implements, 19 Northeast (NE) multispecies (groundfish) sector operations plans and contracts for fishing year (FY) 2012, and allocates quotas of NE multispecies to the sectors. This final rule does not approve certain exemptions and measures proposed in the operations plans, as explained below. Approval of sector operations plans is necessary to allocate quota to the sectors and to grant the sectors regulatory exemptions. This provides vessels participating in sectors with increased operational flexibility while limiting overall fishing mortality. This final rule also announces a preliminary allocation to the New Hampshire State-Operated Permit Bank. "This action partially approves, and implements, 19 Northeast (NE) multispecies (groundfish) sector operations plans and contracts for fishing year 2012, and allocates quotas of NE multispecies to the sectors. This action does not approve certain exemptions and measures proposed in the operations plans. Approval of sector operations plans is necessary to allocate quota to the sectors and to grant the sectors regulatory exemptions. This provides vessels participating in sectors with increased operational flexibility while limiting overall fishing mortality. The environmental assessment determined that there would likely be negligible impacts to habitat, allocated species and non-allocated target species, a low negative impact to endangered and protected species, and a low positive impact on ports and sector participants"--Summary from cover letter.

"The National Marine Fisheries Service (NMFS) prepared this analysis to evaluate potential impacts that would result from the approval of additional exemptions for each of the 17 fishing year (FY) 2013 Multispecies sector operations plans and complimentary changes to the American Lobster Fishery Management Plan (FMP). In accordance with the National Environmental Policy Act (NEPA), this Environmental Assessement (EA) presents impact information on the physical, biological, habitat, and socio-economic ecosystem components that would result in the approval of additional exemptions described herein. As of May 1, 2013, NMFS has approved a total of 17 sectors to operate according to their sectorspecific operations plans under an Annual Catch Entitlement (ACE). A sector is defined as a group of persons holding limited access vessel permits who have voluntarily entered into a contract and agree to certain fishing restrictions for a specified period of time, and which has been granted an ACE in order to achieve objectives consistent with applicable fisheries management plan (FMP) goals and objectives. In the formation of a sector, sector participants can select who could participate (NEFMC 2009). An ACE is defined as the amount of each allocated groundfish stock (in pounds) that a sector can harvest in a fishing year. All other groundfish vessels that are not associated with a sector operate under Common Pool rules, which, among other restrictions, generally control fishing mortality by limiting the number of days-at-sea (DAS)"--Introduction (page 13).

"This action expands on a previously approved sector exemption by allowing groundfish sector trawl vessels to harvest redfish using nets with codend mesh as small as 4.5 inches. In addition, this action allows for sectors to develop an industry-funded at-sea monitoring program for trips targeting redfish wish small-mesh nets. There are no significant impacts associated with this action"--Summary from cover letter.

"Due to the interrelated nature of impacts resulting from the operation of sectors, and exemptions to fishery regulations, NMFS agreed to prepare the required NEPA documentation to accompany the sector operations plans it has or expects to receive for fishing year (FY) 2015-2020. Fishing years for the Northeast Multispecies fishery run from May 1 to April 30 (e.g., FY 2015 is May 1, 2015 through April 30, 2016. This Environmental Assessment (EA) describes the potential impacts of approving FY 2015-2020 sector operations plans on the human, physical, and biological environment. NMFS prepared this EA in compliance with the sector provisions as described in Amendment 16 to the Northeast Multispecies FMP (75 FR 18262 4/9/2010) and as implemented by the regulations at 50 CFR 648.87"--Introduction (page 14).
