GAO discussed the Environmental Protection Agency's (EPA) Technical Assistance Grant (TAG) Program, which provides communities with grants of up to $50,000 to foster their involvement in decisions about Superfund hazardous waste cleanups. GAO noted that: (1) EPA has awarded 103 grants to communities, but they represent only 9 percent of the approximately 1,150 communities that may be eligible for the program; (2) the $5.1-million total dollar value of the grants EPA has awarded so far represents only 29 percent of the grant funds available; (3) limited EPA emphasis on TAG program outreach may contribute to low program participation; (4) there were significant regional variations in grant awards; (5) grant recipients were generally pleased with the benefits they derived from those grants, and primarily used them to hire technical advisors and to keep residents informed about clean-up status and progress; (6) some recipients expressed concerns about the lengthy and labor-intensive application process, procurement procedures that made it difficult to hire technical advisors, and reimbursement procedures that delay grant payments; (7) the extent to which TAG recipients may use grants to independently verify or clarify existing site clean-up analyses or information is unclear; and (8) the impact of the proposed EPA model for accelerating the Superfund clean-up process on the TAG program and community involvement is also unclear.

"At the end of fiscal year 2009, the Environmental Protection Agency's (EPA) National Priorities List (NPL) included 1,111 of the most seriously contaminated nonfederal hazardous waste sites. Of these sites, EPA had identified 75 with unacceptable human exposure, 164 with unknown exposure, and 872 with controlled exposure that may need additional cleanup work. EPA may fund remedial actions-long-term cleanup-from its trust fund, and compel responsible parties to perform or reimburse costs of the cleanup. GAO was asked to determine (1) the cleanup and funding status at currently listed nonfederal NPL sites with unacceptable or unknown human exposure; (2) what is known about EPA's future cleanup costs at nonfederal NPL sites; (3) EPA's process for allocating remedial program funding; and (4) how many NPL sites some state and EPA officials expect to be added in the next 5 years, and their expected cleanup costs. GAO analyzed Superfund program data, surveyed and interviewed EPA officials, and interviewed state officials. "

Under the Superfund program, the EPA places the most seriously contaminated sites on the National Priorities List. EPA may compel site cleanups by parties responsible for contamination, or conduct cleanups itself and have these parties reimburse its costs. The program is funded by a trust fund, which is largely supported by general fund appropriations. This report examines: (1) EPA's enforcement action outcomes and the factors parties consider in reaching these outcomes; (2) any trends in litigation to resolve Superfund liability; and (3) the program's status and costs. The report obtained and analyzed Superfund program data from EPA, as well as data on Superfund litigation from cases filed in U.S. district courts. Includes recommendations. Illustrations.
