Independent legal professionals play a key role in the administration of justice and the protection of human rights. Judges, prosecutors and lawyers need access to information on human rights standards laid down in the main international legal instruments and to related jurisprudence developed by universal and regional monitoring bodies. This publication, which includes a manual and a facilitator's guide, seeks to provide a comprehensive core curriculum on international human rights standards for legal professionals. This is the story of the U.S. Commission on Civil Rights, through its extraordinary fifty years at the heart of the civil rights movement and the struggle for justice in America. Mary Frances Berry, the commission’s chairperson for more than a decade, author of My Face Is Black Is True (“An essential chapter in American history from a distinguished historian”—Nell Painter), tells of the commission’s founding in 1957 by President Eisenhower, in response to burgeoning civil rights protests; how it was designed to be an independent bipartisan Federal agency—made up of six members, with no more than three from one political party, free of interference from Congress and presidents—beholden to no government body, with full subpoena power, and free to decide what it would investigate and report on. Berry writes that the commission, rather than producing reports that would gather dust on the shelves, began to hold hearings even as it was under attack from Southern segregationists. She writes how the commission’s hearings and reports helped the nonviolent protest movement prick the conscience of the nation then on the road to dismantling segregation, beginning with the battles in Montgomery and Little Rock, the sit-ins and freedom rides, the March on Washington. We see how reluctant government witnesses and local citizens overcame their fear of reprisal and courageously came forward to testify before the commission; how the commission was instrumental in passing the Civil Rights Act of 1964 and the Voting Rights Act of 1965; how Congress soon added to the commission’s jurisdiction the overseeing of discriminating practices—with regard to sex, age, and disability—which helped in the enactment of the Age Discrimination Act of 1978 and the Americans With Disabilities Act of 1990. Berry writes about how the commission’s monitoring of police community relations and affirmative action was fought by various U.S. presidents, chief among them Ronald Reagan and George W. Bush, each of whom fired commissioners who disagreed with their policies, among them Dr. Berry, replacing them with commissioners who supported their ideological objectives; and how these commissioners began to downplay the need to remedy discrimination, ignoring reports of unequal access to health care and employment opportunities. Finally, Dr. Berry’s book makes clear what is needed for the future: a reconfigured commission, fully independent, with an expanded mandate to help oversee all human rights and to make good the promise of democracy—equal protection under the law regardless of race, color, sexual orientation, religion, disability, or national origin.
In January 2016, a series of states of emergency for the City of Flint were declared by the Mayor, the Governor and even the President. These declarations turned the attention of the state and nation to the Flint water crisis. As a result, the state, local and federal governments sprang into action. The National Guard was tasked to assist. FEMA1 sent representatives. Community organizations and non-profits from throughout the state, and even nationally, responded by volunteering, and sending bottled water. The Governor formed Mission Flint, which brought key members of the Administration together weekly, and the Legislature authorized a supplemental budget. Bottled water and water filters were distributed and residents were provided information in multiple languages. It was all hands on deck. From all accounts, the government was operating the way we would expect it to operate in response to an emergency. What then, was the problem? The timing. Preceding this flurry of "state of emergency" activity, Flint residents had been reporting heavily discolored and bad tasting water for well over a year. This report is triggered by the Flint Water Crisis, but in many ways is not just about Flint. This report seeks to outline a broader framework to explain why the crisis occurred and to propose a set of recommendations that minimizes and safeguards against similar crises in the future. Our report is not meant to assess blame, but to help ensure that such a crisis does not occur in the future and to address shortcomings that continue to persist over time.
Although historians have devoted a great deal of attention to the development of federal government policy regarding civil rights in the quarter century following World War II, little attention has been paid to the equally important developments at the state level. Few states underwent a more dramatic transformation with regard to civil rights than Michigan did. In 1948, the Michigan Committee on Civil Rights characterized the state of civil rights in Michigan as presenting "an ugly picture". Twenty years later. Michigan was a leader among the states in civil rights legislation. Expanding the Frontiers of Civil Rights documents this important shift in state level policy and makes clear that civil rights in Michigan embraced not only blacks but women, the elderly, native Americans, migrant workers, and the physically handicapped. Sidney Fine's treatment of civil rights in Michigan is based on an exhaustive examination of unpublished, published, and interview sources. Fine relates civil rights developments in Michigan to civil rights actions by the federal government and other states. He focuses on the administrations of the three governors -- Democrats G. Mennen Williams (1949-1960), and John B. Swainson (1961-1962), and Republican George Romney (1963-1969) -- and the roles they played in furthering civil rights in Michigan, as well as other politicians and policymakers. Students of state history, civil rights history, and those interested in post-World War II history will find few accounts as broad ranging as this study of state civil rights legislation during the years the book covers.
Just as Mississippi whites in the 1950s and 1960s had fought to maintain school segregation, they battled in the 1970s to control the school curriculum. Educators faced a crucial choice between continuing to teach a white supremacist view of history or offering students a more enlightened multiracial view of their state's past. In 1974, when Random House's Pantheon Books published Mississippi: Conflict and Change (written and edited by James W. Loewen and Charles Sallis), the defenders of the traditional interpretation struck back at the innovative textbook. Intolerant of its inclusion of African Americans, Native Americans, women, workers, and subjects like poverty, white terrorism, and corruption, the state textbook commission rejected the book, and its action prompted Loewen and Sallis to join others in a federal lawsuit (Loewen v. Turnipseed) challenging the book ban. Charles W. Eagles explores the story of the controversial ninth-grade history textbook and the court case that allowed its adoption with state funds. Mississippi: Conflict and Change and the struggle for its acceptance deepen our understanding both of civil rights activism in the movement's last days and of an early controversy in the culture wars that persist today.
