This book concerns Catalonia, the north-eastern part of the Iberian peninsula, during the Middle Ages. Centered around the great port city of Barcelona, Catalonia formed the richest and culturally most advanced part of what became the kingdom of Aragon, and extended its commercial and political power throughout the Mediterranean. Two themes in particular are emphasized: the role of the Catalan church in its society, and the condition of the peasantry, especially with respect to serfdom. Questions of episcopal power in relation to monasteries, urban society and the state are discussed in the first eight articles. The remainder consider the reasons for peasant servitude in a region that had previously enjoyed a free system of land tenure. In addition, the essays aim to compare the experience of Catalonia with the more widely-studied realms of northern Europe and with the other Spanish kingdoms.

Crises are never the best of times and the era of the Great Western Schism (1378-1417) easily qualifies as one of the worst of times. As a professor of canon law at the University of Padua and later cardinal, and as a major theorist in the conciliarist movement, Franciscus Zabarella (1360-1417) tried to do what a good legal mind does: find and explicate a viable and legal solution to the crises of his time, a solution that would stand up in his own era and for the generations that followed. In this volume Thomas Morrissey looks at what he said, wrote and did, and places him and his thought in the context of the late medieval and early modern era, how he reflected that world and how he influenced it. Particular studies elucidate what he wrote on the authority and on the duty of the people in power, what they could do and should do, as well as what they should not do. They also show how he explored the area of early constitution law and human rights in civil and religious society and that his work leads down the road to our modern constitutional democratic societies. The volume includes two previously unpublished studies, on the situation in Padua c. 1400 and on a sermon from 1407, together with an introduction contextualizing the articles.

The two themes brought together in this volume - the canon law and the liturgy of the early medieval Latin Church - have close links, as these articles reveal. At the basis of this lies that fact that the collections and manuscripts with which Professor Reynolds is concerned provide the source material for both fields of study. In the book particular emphasis is given to the Irish Collection canonum hibernensis and its many derivatives, to works from Carolingian Salzburg and eleventh-century Southern Italy, and to liturgical collections. 'Inquisition' was the new form of criminal procedure that was developed by the lawyer-pope Innocent III and given definitive form at the Fourth Lateran Council of 1215. It has since developed a notoriety which has obscured the reality of the procedure, and it is this that Professor Kelly is first concerned with here. In contrast to the old Roman system of relying on a volunteer accuser-prosecutor, who would be punished in case of acquittal, the inquisitorial judge himself served as investigator, accuser, prosecutor, and final judge. A probable-cause requirement and other safeguards were put in place to protect the rights of the defendant, but as time went on some of these defences were modified, abused, or ignored, most notoriously among papally appointed heresy-inquisitors; but in all cases appeal and redress were at least theoretically possible. Unlike continental practice, in England inquisitorial procedure was mainly limited to the local church courts, while on the secular side native procedures developed, most notably a system of multiple investigators/accusers/judges, known collectively as the jury. Private accusers, however, were still to be seen, illustrated here in the final pair of studies on 'appeals' of sexual rape.

'Pioneers' seems fitting to Professor Gouron to describe the jurists (civilists) of the 12th-century Latin West, that were the bearers of a new science, born in Bologna about 1100. Away from Bologna these pioneers were isolated, scattered from Scotland to Styria or Catalonia, and no more than one hundred can now be identified. Though it may not be immediately obvious why articles on topics from such distantly removed areas of western Europe - the Iberian peninsula and southern Italy - should appear in the same volume (the fourth collection by Roger Reynolds), the materials covered illustrate that they are indeed closely related, both in their differences and their similarities. Both peninsulas had their own indigenous liturgies and music (Old Spanish and Beneventan), distinctive written scripts (Visigothic and Beneventan), and legal and theological traditions, and repeatedly these worked their influence on other areas of western Europe. Although there were frequent attempts by the papacy and secular rulers from the 9th to the 13th century to suppress these distinctive traditions in both areas, elements of these nonetheless survived well into the 16th century and beyond. Despite the differences in these traditions, the articles in this volume also demonstrate through manuscript evidence the continued exchange of the distinctive customs between the Iberian peninsula and southern Italian cultures from the very early Middle Ages through the 12th century.
