Final Rule Interpreting the Scope of Certain Monitoring Requirements for State and Federal Operating Permits Programs (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Final Rule Interpreting the Scope of Certain Monitoring Requirements for State and Federal Operating Permits Programs (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The purpose of this action is to finalize interpretation of certain existing federal air program operating permits regulations. We proposed an interpretation of these rules on June 2, 2006, and requested comment. This final interpretation responds to the comments we received. The final interpretation is that the plain language and structure of certain sections of the operating permits regulations do not provide an independent basis for requiring or authorizing review and enhancement of existing monitoring in title V permits. We believe that other rules establish a basis for such review and enhancement. Such other rules include the monitoring requirements in certain other sections of the federal operating permits regulations (i.e., periodic monitoring), existing federal air pollution control standards, and regulations implementing State requirements to meet the ambient air quality standards. Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is establishing air quality designations in the United States (U.S.) for the 2012 primary annual fine particle (PM 2.5) National Ambient Air Quality Standards (NAAQS) for five areas in Georgia and neighboring counties in Alabama and South Carolina. The EPA is also changing the initial designation of one area in Ohio, two areas in Pennsylvania, one area shared between Indiana and Kentucky, and one area shared between Kentucky and Ohio for the 2012 PM 2.5 NAAQS. These states have recently submitted complete, quality-assured, and certified air quality data for 2014, and based on that data the EPA is finalizing appropriate initial designations for these areas. Lastly, the EPA is making one minor technical amendment to correct an inadvertent error in the initial designation for a county in Pennsylvania with respect to the 2012 PM 2.5 NAAQS. Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is approving State Implementation Plan (SIP) revisions submitted by the State of Connecticut on December 1, 2004. Specifically, EPA is approving revisions to Connecticut's visible and particulate matter (PM) emissions, recordkeeping and monitoring regulations. These revised rules establish and require limitations on visible and PM emissions for stationary sources, and clarify reporting requirements for operation of air-pollution-control and monitoring equipment. EPA is approving this SIP revision because EPA has determined that it will not interfere with attainment or maintenance of the national ambient air quality standards (NAAQS) in Connecticut or with any other applicable requirements of the Clean Air Act (CAA). Determinations Concerning Need for Error Correction, Partial Approval and Partial Disapprival, and Federal Implementation Plan Regarding Texas (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Determinations Concerning Need for Error Correction, Partial Approval and Partial Disapprival, and Federal Implementation Plan Regarding Texas (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 EPA is finalizing a correction to its previous full approval of Texas's Clean Air Act (CAA) Prevention of Significant Deterioration (PSD) program to be a partial approval and partial disapproval and is also promulgating a Federal Implementation Plan (FIP) for Texas. These actions are based on EPA's determination that at the time EPA approved Texas's PSD program, the program was flawed because the state did not address how the program would apply to all pollutants that would become newly subject to regulation in the future, including non-National Ambient Air Quality Standard (NAAQS) pollutants, among them greenhouse gases (GHGs). The partial disapproval requires EPA to promulgate a FIP and EPA is doing so to assure that GHG-emitting sources in Texas are able to proceed with plans to construct or expand. Transportation Conformity Rule PM2.5 and PM10 Amendments (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Transportation Conformity Rule PM2.5 and PM10 Amendments (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 In this action, EPA is amending the transportation conformity rule to finalize provisions that were proposed on May 15, 2009. These amendments primarily affect conformity's implementation in PM 2.5 and PM 10 nonattainment and maintenance areas. EPA is updating the transportation conformity regulation in light of an October 17, 2006 final rule that strengthened the 24-hour PM 2.5 national ambient air quality standard (NAAQS) and revoked the annual PM 10 NAAQS. In addition, EPA is clarifying the regulations concerning hot-spot analyses to address a December 2007 remand from the Court of Appeals for the District of Columbia Circuit. This portion of the final rule applies to PM 2.5 and PM 10 nonattainment and maintenance areas as well as carbon monoxide nonattainment and maintenance areas.
