Excerpt from A Selection of Cases on Commercial Law Real Estate law, though important, is hardly a' part of commercial law. It is too technical to be presented satisfactorily in a beginning course. Very few cases have been chosen on the subject, as any ex tensive treatment should be deferred until the student has mastered the elementary principles. Excerpt from Cases on Commercial Law: Contracts, Agency, Sales, Negotiable Paper, Partnerships, Corporations These cases have been prepared for the use of students in Commercial Law. When the writer took charge of the Commercial Law classes in Northwestern University, some years ago, he doubted whether he could profitably use cases as material for assigned lessons, and he therefore relied upon mimeographed notes in the form of a text, using cases only in brief paraphrase as illustrations, and these notes were afterwards put in type and published in the form of small hand books. But it was noticed that when the writer dwelt in his lectures on the facts Of actual cases and stated the court's decision and read from the Opinion, the stu dent seemed deeply interested, and retained the matter better in his memory than other parts of the work. From this experience, the writer became convinced of the value of the use of cases, in his classes, and he has used them in mimeograph form in connec tion with text for some time with considerable success. Excerpt from Commercial Law The author of this work has aimed to select from the exten sive field of the law those fundamental principles, a knowledge of which the business man will most frequently find of value to him, and which the teacher of Commercial Law will regard most useful to his classes. It is not the purpose of this volume to make lawyers of its readers, but to teach them to discern the ways that lead from litigation, and to enable them to conduct their business dealings with an intelligent idea of their legal rights and limitations. Excerpt from Leading Cases Commercial Law England and Scotland: Selected and Arranged in Systematic Order, With Notes Lawrence, J - From the loose manner in which the clause is worded, I at first entertained some doubt upon the question; but upon further consideration, I agree with my lord and my brothers upon their construc tion of it. If the question had arisen merely on the first part of the clause, I conceive that it would only have been necessary that the promise should have been stated in writing; but it goes on to direct that no per. Son shall be charged on such promise unless the agreement, or some note or memorandum thereof, that is, of the agreement, be in writing, which shows that the word agreement was meant to be used in a sense different from promise, and that something besides the mere promise was required to be stated. And as the consideration for the promise is part of the agreement, that ought also to be stated in writing. Excerpt from Commercial Law Cases, Vol. 2 of 2 The divisions of the law contained in this volume, Negotiable Instruments, Partnership, and Corporations, comprise the subjects ordinarily taken up in the second year of legal study, after the student has become familiar with the principles embodied in the general law of contracts and agency, and, particularly, after h has attained to some conception of the method of legal reasoning. Perhaps the most difficult task confronting the instructor at the outset is the inculcation of the principles underlying the orderly advance of logical argument. The successful completion of the first year's work presupposes that these have been, to some degree at least, assimilated; and more time may now be devoted - as, indeed, the exigencies of these subjects require - to correspond ingly broader range of illustration. Excerpt from Commercial Law Cases, Vol. 1 of 2 It may be considered that the book appears too large for classes which have a limited time at their disposal. This difficulty is more apparent than real, as it is feasible for the instructor to skip cases at will and thereby choose for himself only the more important ones. Furthermore, it is possible and very practicable to require no reading of the Opinion of the court in many cases. While the book has been in preparation, the authors have been furnishing their classes with mimeographed statements of facts and holdings, with no opinion appended. This system has worked well and can be used to advantage even with the book in complete form by omitting the reading of the opinion. The course may be much shortened by the elimination of this requirement, and at the same time those students who desire to do additional work will have the material at hand. Excerpt from A Text Book of Commercial Law, as Existing in California In law, more than in any other science, originality is not to be attained. Every principle in this book has been stated before, and perhaps stated better than it is here. The standard text-writers have been liberally con sultedf Kent's Commentaries, Smith's Mercantile Law, Parson on Con. Tracts, and the California Codes, have been most freely referred to. The arrangement, the presentation of each subject, and the statement of principles are, however, new, and whatever of merit there may be in these.
