Excerpt from A Practical Treatise on the Law of Trusts, Vol. 1 Since the publication of the last Edition of this work several important Acts of Parliament have been passed, which have given rise to numerous, and in many cases fundamental, changes in the law as affect ing'the relative positions of trustees and their cestuis. Que trust, and their respective rights and powers. These, together with the continual modifications in the law arising from the ow of cases through the Courts, have caused a considerable increase in the size of the present Edition. One new chapter and an additional section to another chapter have been introduced, pointing out the prin cipal provisions of the Settled Land Acts as they affect the law of trusts, but a general consideration of these Acts does not seem to fall within the purview of the present work. Excerpt from A Practical Treatise on the Law of Trusts and Trustees The correction of the press was kindly undertaken for the Author by Mr. F. O. Haynes, whose extensive knowledge of law and careful research are well known at the Chancery Bar. Had the labours of Mr. Haynes gone no further, the Author would have felt grateful for the assistance, but in fact, Mr. Haynes, as the sheets passed through his hands, has identified himself with the Author, and examined into the law - has inserted additional authorities which had been inadvertently omitted, and corrected mistakes into which the Author had occasionally fallen. Moot points, also, as they arose have been freely discussed, and the reader has the benefit of the conclusions arrived at. The Author is of course to be held responsible for the errors which remain, but the value of the work (whatever it may be) has been unquestionably much enhanced by the legal acumen and learning which Mr. Haynes has imported into it. Excerpt from A Treatise on the Law of Trusts and Trustees, Vol. 1 of 2 IN all the courts of last resort in this country, the judges, continually and as a perfectly understood and settled thing, refer to Perry on Trusts as the standard authority upon all questions of law and equity pertain ing to its subject-matter. Many times eminent judges in writing their Opinions have deemed it sufficient proof of a principle or rule they wished to make use of, simply to state it with a reference to Perry; and indeed few judges could hope to arrive at more correct conclusions or more convincing proof of them than the clear, strong mind and intense industry of the author enabled him to attain. The heart's blood of his best manhood he poured into this study; many buried years bloom in this book, - it is the flower Of a vigorous life.
