The European Scrutiny Committee assesses the legal and/or political importance of each EU document, decides which EU documents are debated, monitors the activities of UK Ministers in the Council, and keeps legal, procedural and institutional developments in the EU under review. It is estimated that at any one time 4,500 EU nationals are held in custody in countries other than their normal place of residence. As they are less likely to be granted bail (because of a greater perceived of absconsions) the Commission has proposed a European supervision order (ESO), which would mean that authorities in a person's home State would also be responsible for returning them for trial. This report examines the proposal in detail and makes some recommendations for improvement. The Committee welcome the proposal and think it deserves prompt attention by Member States.

The European Commission want to set up a European Institute for Gender Equality to collect and analyse data, carry out research and promote exchanges of information and good practice about gender issues in the EU. The European Union Committee expresses the view that a separate body of this kind is not needed, and that more consideration should be given to the case for incorporating gender equality work in the proposed European Fundamental Rights Agency. The Committee also states that the establishment of such a body requires a good management structure along with adequate funding. The Committee further states that the Government should take a clear and consistent line on the correct legal base for this and similar proposals.

This progress report presents evidence taken by the Committee during the summer recess on the draft EU Reform Treaty on which negotiations have been proceeding in the Inter Governmental Conference (IGC), as well as correspondence raising questions with the Minister for Europe. The Committee sets out its plan for further in depth analysis of the impact of the reform Treaty on the UK and discusses specific questions of the role of national parliaments. The report notes the tight mandate given to the IGC has had the effect that its work has been largely technical and asks the Government to report to the House on the impact of this procedure.

The Commission has proposed the creation of an EU Fundamental Rights Agency. The Agency's principal task will be to provide assistance and expertise to EU institutions and Member States when implementing Community and third pillar legislation. While it has been broadly welcomed by Member States, national human rights institutes and non-governmental organisations, there are concerns that the Agency's activities may overlap with those of other bodies in the field and more particularly, with the work of the Council of Europe. This Report discusses the extent to which duplication might arise. Chapter 3 looks at the geographic scope and remit of the Agency and considers the extent to which these will result in overlap with the Council of Europe. Aside from human rights bodies in general, there is the potential for duplication between the Agency and the proposed European Institute for Gender Equality. Chapter 4 discusses whether there is a need for two separate bodies or whether the Fundamental Rights Agency should be responsible for all fundamental rights and discrimination matters, including gender issues. Finally the Committee considers whether the Agency will be sufficiently independent from the Commission and the Council and makes recommendations as to the composition of the Agency's management and executive board.
