DOWNLOAD EBOOKIn its report of last year on the Communities and Local Government's Departmental Annual Report 2007 (HC 170, session 2007-08, ISBN 9780215037978) the Committee commented on the particular nature of the Department's work: on its unusual reliance for the achievement of the goals Government has set it on a plethora of other Departments, agencies, non-departmental bodies, local authorities and other stakeholders; on the long, devolved delivery chains by which those goals therefore have to be delivered; and on the skills of influence, brokering and negotiation which are required to achieve them. In this Report the Committee assesses the progress made since last. The most recent Cabinet Office Capability Review concludes that there has been a positive "direction of travel" for CLG in that period, but the Committee concludes that there is still some way to go before CLG can be said to be performing at the highest achievable level of effectiveness. The Department's overall performance against its Public Service Agreement targets is likewise moving in the right direction but still short of full effectiveness. Achievement of efficiency targets is applauded. Finally, the report considers examples of particular policies which highlight some of the Department's strengths and weaknesses, and follow up some issues in earlier inquiries. These issues include: eco-towns; the Decent Homes programme; Home Information Packs; Fire Service response times; Firebuy; the FiReControl programme. The report also considers the Department's response to the serious flooding of summer 2007, and to the reviews which followed; and the mismanagement of European Regional Development Fund monies.

DOWNLOAD EBOOKThe UN Convention on the Rights of Persons with Disabilities builds on existing human rights treaties including the International Covenant on Civil and Political Rights and the International Covenant on Economic Social and Cultural Rights. The UN Handbook for Parliamentarians on the Convention stresses that it is not intended to create new rights, but "clarifies the obligations and legal duties of States to respect and ensure the equal enjoyment of all human rights by all persons with disabilities". Its purpose is to: "Promote, protect and ensure the full enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity." The UK was among the first countries to sign the Convention on 30 March 2007. The findings of our recent inquiry on the rights of adults with learning disabilities showed that although UK law and policy on the treatment of adults with learning disabilities takes a human rights based approach, the day to day experiences of people with learning disabilities are not so positive. Ratification will send a strong signal to all people with disabilities in the UK, and abroad, that the Government takes equality and the protection of their human rights seriously. The Government first publicly stated that reservations to the Convention were being considered in its response to our Report on the treatment of adults with learning disabilities, in May 2008, more than a year after it signed the Convention. Despite the Committee's call for a full explanation of the government's views on the compatibility of domestic law with the Convention, the were then provided with little detail on the reservations being considered or the Government's approach to the process. The Committee considers that progress towards ratification of the Convention by the UK has so far lacked transparency and has unfortunately alienated disabled people and their organisations. This is unacceptable in the light of the clear Convention commitment which the Government intends to make to the involvement of disabled people in the development of policies and laws which affect them. This approach undermines the previous role that the UK Government has played in championing equality for disabled people and their leading role in negotiating the terms of the UNCRPD.

The fiscal stimulus measures intended to pull the economy out of recession represent an invaluable opportunity to transform the UK into a low carbon economy. But meeting climate change and renewable energy targets will require a step-change in environmental investment. This year's Pre-Budget Report announced a £535m package of green fiscal stimulus measures designed to tackle economic and environmental problems simultaneously. This investment is welcome, but the scale too small- most of this funding was already committed, and will be offset by reduced spending in 2010-11. Extra funding announced for the Warm Front programme will not deliver the scale and speed of change that is needed. Programmes aimed at improving the energy efficiency of existing buildings should be the number one priority for green fiscal stimulus. It is disappointing that the wider fiscal stimulus package contains hundreds of millions of pounds for road building and widening. The Treasury should publish an assessment of the net impacts of its fiscal stimulus package on the environment. The second part of the report looks at green taxation. In real terms, revenue from green taxes has gone down slightly since 1998, while revenue from all taxation has increased by around 30 per cent. On aviation taxes, the Committee criticise the Treasury's backtracking on replacing Air Passenger Duty with a 'per plane' charge, and exhorts the Government to seek reform of the Chicago Convention so as to allow taxation of international aviation fuel. On motoring taxes, it calls for re-examination of the merits and practicalities of a 'car scrappage' scheme to pay people to trade in their existing, older cars, for newer, more efficient models.

Instead of indulging in pre-election politicking, all the parties should come together to map out sustainable reform. Consensus on the details of reforms must be achieved early in the new Parliament and a failure to do so will betray current and future generations. The report says the current social care system is chronically underfunded, severely rationed, locally variable, too often of poor quality and discriminates against older people. The Committee is highly critical of the Government's Free Personal Care at Home Bill which it says smacks of policy-making on the hoof and risks creating perverse incentives and being substantially underfunded. Free care funded from taxation has many supporters but has been ruled out as an option by the Government. The Committee urges debate on this issue. It also acknowledges the widespread concern about the proposed reform of disability benefits for older people, noting the lack of clear information from the Government on who the winners and losers will be. To mitigate significantly the worst aspects of the existing funding system, as an interim measure, the Committee recommends raising the capital thresholds in the means test. The Committee strongly supports giving people more choice and control over their care and support, but emphasises that vulnerable people must be properly protected.
