Excerpt from The Grant and Validity of British Patents for Inventions Abstracts of Cases will render it useful to practising lawyers. It has been ascertained by an official inquiry that of the Patents for Inventions granted in England no fewer than 42 per cent., that is, about 5780 per annum, are invalid on the ground of having been already patented in this country. An examination of the results of litigation shows that, of such patents as are commercially worth infringing, no less than 51 per cent. Are invalid. The invalidity of these patents is in many cases not discovered till after the lapse of years but, even assuming that no invalid patent is renewed, sums amounting to 2 per annum are paid for patents which give no legal protection to the patentees. This state of affairs brings discredit upon all British patents, and diminishes the market value even of those which are valid. Although the new procedure shortly to be brought into operation will prevent the grant of a large proportion of bad patents, many will still exist, as it deals only with one cause of invalidity. Excerpt from An Essay on the Law of Patents for New Inventions Another British writer, whose work may be styled the text book of statesmen, thus complains of the de leterious effects on society and civilization, which arise from the drudgery incident to the manipulations of ex tensive manufactories, which may be greatly alleviated, and in some instances, almost annihilated, by labor-sav ing machinery. In the progress of the division of labor, the employment of the greater part of those who live by labor, that is of the great body of the people, comes to be confined to a few very simple operations; frequently to one or two. But the under standings of the greater part of men are necessarily formed by their ordinary employments. The man Whose whole life is spent in performing a few simple Operations, of which the effects too, are perhaps, always the same, or very nearly the same, has no occasion to exert his understanding, or to exercise his invention in finding out expedients for removing difficulties, which never occur. He naturally loses, therefore, the habit of such exercise, and becomes as stupid and ignorant as it is possible for a human creature to become. The torpor of his mind renders him not only incapable of relishing or hearing a part in any rational conversation. Excerpt from The Law and Practice: Relating to Letters Patent for Inventions, With an Appendix of Statutes, Rules, and Official Forms The author believes that the text refers to all the reported cases which are now of any importance. It contains no reference to matters and cases which are of historical interest only. As the decisions concerning grants of compulsory licences under section 22 of the Patents Act, 1883 - now repealed - will, it is conceived, be of little or no value.
