Excerpt from The Government of England: Its Structure and Its Development The English Constitution forms a part of the Common Law. Our government by King, Lords, and Commons, the mutual relations of these several powers, our Constitution courts of law and of equity, our great offices of State, are all, and from their earliest rudiments have been, known to the law, and recognized by it. Obvious as this proposition now appears, it has not always been followed in practice; even yet, perhaps, it sometimes is not thoroughly understood. To the ingenious inventors of paper constitutions in the last century the unwritten traditions of our political system supplied a favourite subject for sarcasm and contempt. These politicians could not believe in any system of polity which was not expressed in words and figures; where there was no delicate adjustment of powers, and where the right of men to cashier their rulers was not prominently set forth. But the law of political conditions, like the law of property or the law of obligations, or any other portion of our jural system, needs not the formal statement of a code. "That ancient collection of unwritten maxims and customs," of which this branch of our law forms a part, has its own inherent vitality. Excerpt from Local Government in England, Vol. 1 of 2 This book is the result of studies, prosecuted for many years, concerning the development of the domestic politics of England during the nineteenth century. What remains to be said of the origin and plan of the book, besides the explanations given in the introductory chapter, is mainly of a personal character. When I came the first time to the shores of England, more than ten years ago, it was as a student of English Law and Constitution entirely imbued with the ideas and judgments which the great German jurist and scholar, Rudolf von Gneist, had expressed in the many legal and political writings of his long career. But soon I discovered that those writings were not only in many ways obsolete, having been long passed by current practice and by modern legislative reforms, but also that the general idea of the modern political history of England, as given by Gneist, stood in inexplicable contradiction to the real development and the true nature of political facts. These first impressions have been strengthened by incessant study in England itself, until out of my doubts of the theories and judgments of Gneist there has resulted a view of modern English politics, independent of, and in essence opposed to, those views of Gneist which have so constantly been accepted as authoritative by continental learning. By the animal nature is here simply meant the impulses which lead to the love of acquisition and the glory of the battle-field, - both as purely animal impulses as any that mark the beasts that perish; both happily, now, though only very recently, reduced, in all most civilized comma nitiea under subjection to the moral and intellectual nature of man. Hence, in such political histories, battles and their details are too ti'equent. Nations, until a very recent period, have ia variably had recourse, in the settlement of all disputes, to the barbarous form of wager of battle, to decide the right, although, by the express laws of almost every nation in Europe, wag-sr of battle between individuals has been long abolished. It is extra ordinary that so barbarous and absurd a custom should have been thus so inconsistently persevered in, in the one case, while it has been abolished in the Other. The public mind in England is, however, at the present time, in general, as much opposed to the appeal to this antiquated ordeal in the one case as the other; and it is to be hoped that the page of the future historian will abound chie y in details of the moral and intellectual history of that as well as other nations; and that the history of society, of science, and of literature, will take high precedence of the his tory of politics. Meantime, the history of the politics of every nation must be studied by 'all who would observe the advance of nations, or truly understand their actual condition. More especially is that study important in respect of those nations where, as in England, the struggle between general independence and assumed individual prerogative, has been long continued and eventful, though crowned at last with noble and glorious success. Excerpt from The Government of England, National, Local, and Imperial I have attempted to describe the English government as it is without distracting the reader with a long account of how it came to be what it is. Moreover, I have avoided the common habit of first describing the government as it is supposed to be in theory and then following this with an equally detailed account explaining that it is not really this, but something very different. The reader will observe too that I have all along kept in mind the resemblances and contrasts between the government of England and that of our own country, not only because of the interest in such a parallel, but because of the practical lessons which it supplies. I hope that the book may find a serviceable place in college classes where the time at command, as is frequently the case, is too limited for an extended treatment of so large a subject as the British government. The general reader desiring a brief, untechnical account of the British government will also doubtless find it a convenient handbook.
