DOWNLOAD EBOOKExcerpt from Western Pacific Railway Company (a Corporation), Appellant, Vs; Southern Pacific Company (a Corporation) Et Al;, Appellees: Appeal From the United States Circuit Court, Northern District of California; Argument of F. W. M. Cutcheon, on Behalf of Western Pacific Railway Company, Appellant He quotes other similar expressions. But it is plain that in all this, Mr. Justice Field intended merely to hold that the Pueblo lands were bounded by the margin of the bay, not necessarily by any actual line of tide, and that in carrying the boundary of the Bay of San Francisco along the San Francisco water front, the sur Vey line should follow the line of high tide of the bay until it reached the mouth of Mission Creek, and follow the line of high tide of the bay beyond the mouth of Mission Creek, but that the boundary line of the grant would leap across Mission Creek from point to point of the broken high tide line. This is the only reasonable construction of his language, and there is nothing in the phraseology employed that points to an intention that a different construction should be given to it.
