Written with policymakers and practitioners in mind, the essays in this volume address some of the most pressing questions arising in services trade today—some of which were not addressed by the first generation of GATS negotiators.

DOWNLOAD EBOOKThis paper compares estimates of the gains from eliminating barriers to trade in services with those from eliminating post-Uruguay barriers remaining in the traditional areas of agriculture and manufacturing. It uses a model that incorporates a bilateral treatment of foreign direct investment, one of the key vehicles by which services are traded internationally. The model is a version of GTAP with foreign direct investment, known as FTAP.

DOWNLOAD EBOOKThis book addresses topical questions concerning the legal framework of trade in services, and assesses how these issues are dealt with in GATS and in selected preferential trade agreements. In addition, the chapters discuss whether the differences and similarities (if any) are evidence of greater coherence or greater divergence. The book combines the individual analyses to provide a more comprehensive picture of the current law on services trade liberalisation.A quarter of a century after the conclusion of the General Agreement on Trade and Services (GATS), international law on trade in services is still in a state of flux: on the one hand, countries increasingly conclude bilateral and regional trade agreements with sections on trade in services that aim at a further liberalisation of services trade. On the other, the GATS structure remains the dominant model and serves as the basis for many preferential trade agreements. In addition, new aspects such as electronic commerce, data protection and taxation are now emerging, while issues that had already manifested in the mid-1990s such as financial services regulation, labour mobility, and telecommunications continue to be problematic. Usually, the debates focus on the question of whether preferential trade agreements serve as a stepping-stone or stumbling block for trade liberalisation at the multilateral level. However, it can be assumed that rules on trade in services in preferential trade agreements will coexist with the global GATS regime for the foreseeable future. This raises the question of whether we’re currently witnessing a drive towards greater coherence or more divergence in agreements on trade in services.

DOWNLOAD EBOOKThis study aims to investigate the normative and economic implications of multilateral market openings and regulatory harmonisation of the global services sectors beyond the bilateral and WTO/GATS frameworks. The mobile communications industry serves as the initial benchmark analysis in order to empirically assess whether the multilateral liberalisation of the global services market can potentially respond more effectively to the growing transnational competition in production inputs, consumption outputs, and capital attraction in a broader pool of service-oriented economies. Ultimately, this study argues that the multilateral opening of the global services market is on balance beneficial to the domestic services industries, and as such the WTO/GATS framework can be superseded by further economic integration and regulatory harmonisation in future multilateral trade agreements currently under negotiation, such as the Trade in Services Agreement (TiSA).

DOWNLOAD EBOOKA Brookings Institution Press and the Organization of American States publication The services sector—including financial services, telecommunications, transportation, tourism, and professional services—has become critical to the continued economic dynamism in the Americas. And the quality and competitiveness of this sector are essential to economic growth and development. On average, services—increasingly traded in more numerous and far-reaching ways than goods—account for nearly two-thirds of the gross domestic product of the Western Hemisphere. The importance of the sector, however, is disproportionately large in Central America and the Caribbean, where it often is the major source of employment and of foreign exchange. This timely volume is the first to review and analyze trade agreements covering the services sector in the Western Hemisphere and their relationship to the General Agreement on Trade in Services (GATS), in force since 1995 as an integral part of the World Trade Organization (WTO). Negotiations on liberalizing services trade are continuing at the multilateral, the regional or hemispheric, and the subregional levels. It is imperative to understand what is being discussed and implemented at these different levels and to articulate the linkages and relationships among the various agreements and the disciplines and obligations they contain. Services Trade in the Western Hemisphere informs the reader about these issues and more. Part 1 deals with the main issues relevant to the liberalization of services trade at the multilateral and regional levels, including improvements to the GATS architecture, the scope of regulatory reform, the relationship between the treatment of services and investment, WTO requirements that must be fulfilled by parties to an economic integration agreement, and disagreements brought to the multilateral dispute settlement process. Part 2 examines the scope, content, and liberalizing approach of subregional agreements in the Western Hemisphere, such as the North American Free Trade Agreement and those p
